The financial crisis that swept the world in 2008 was in deep correlation with real estate policies. Overheated mortgage system brought about a crash in real estate prices and resulted in a credit crisis. It has been an experience for us to reconsider the identity and significance of the real estate brokerage system when promulgating and implementing regulations regarding the economy, finance, and real estate.
Since 2006, we have adopted and enforced the "mark-to-market-value" system as part of our policy on real estate. A primary effect of this has been to demand that not only the deal makers but also the public realtor(공인중개사) report market value of properties. The reason for that has been to prevent all parties from devising double-contracts used for tax evasion, along with the idea that real estate policies can be drawn more reasonably if market value is well recognized.
Although it is out of the question that dealing parties of real estate should be required to report the market value, forcing the public realtor to act likewise seems to pose a problem. In the sale of real estate, a public realtor takes a role of merely of a third party and is not directly involved in the deal making process. In other words, the mark-to-market-value system and its stated purpose of introduction may be just, but it is questionable in terms of constitutionality whether it serves as an appropriate means to achieve such goals. This denotes that the legal responsibility for public realtor to report market value should be abolished in the current status where the system is taking root.
