In imperialism, the police system played its role as a spearhead for effective rule over colonies. Criminal justice by modern police has appeared in a form that pursues extreme investigative efficiency and distances itself from criminal justice. This is revealed in the process of enacting and revising the Japanese Criminal Procedure Law in 1880 (Chizaiho), the Japanese Code of Criminal Procedure in 1890 (Meiji Code), and the Japanese Code of Criminal Procedure in 1922 (Taishō Code). The special police system emerged from the change to criminal justice by the police, and is now recognized in more and more fields of work. Since it essentially pursues the efficiency of investigations for specific scope, it is necessary to consider the nature of violations of fundamental rights by non-experts in the investigation. Currently, the special judicial police systems in Korea and Japan are becoming more specialized and differentiated in the pursuit of investigative expertise and efficiency in line with a complex society. Nevertheless, differences between Korea's method of regulating in general laws and Japan's method of regulating in individual laws are bound to arise in the establishment of special judicial police or system maintenance. At this point, it is necessary to pay attention to the changes in the special judicial police systems of both countries.
