사회복지와 법의 만남 : 법적 관점에서의 통합적 사회복지법제 이해

국문 초록 (Abstract)

『사회복지와 법의 만남』은 법학과 사회복지학의 만남이며 사회복지전문직과 법전문가와의 만남이다. 본서의 가장 독창적인 특징은 ‘사회복지법제의 통합적 접근모형’에 있다. 헌법과 법령, 행정규칙, 조례로 이어지는 ‘법의 수직적 구조’와 입법·행정·사법체계간의 ‘기능적 관계’를 기반으로 한 이 접근모형은 전체 12장에 걸친 각 주제를 관통하는 프레임이 된다. 본서는 사회복지법제론 기본서로서 이론적 개념적 지식에 더하여 관련된 50여개의 사례와 판례들을 제시하는 내용적 구성을 취한다. 입법과정과 사법절차에서의 사회복지사 역할을 비롯하여 사회복지법령 규정이 사회복지정책과 실천과정에서 어떻게 구현되고 있는지 구체적으로 담고 있다. 노인복지법과 소방법의 상반된 규정으로 인해 치매노인이 사망한 사건 이후 관련 시행규칙이 개정된 사례에서부터 헌법재판소의 인간다운 삶 보장 기본권에 대한 해석 판례에 이르기까지 다양하다. 사회복지법제 분야의 연구와 교육경험을 바탕으로 저술된 본서는 무엇보다 사회복지법제 학습의 생생한 동기를 부여하고 재미있고 쉽게 이해할 수 있도록 집필되었다.

"Social Welfare and Law" is a meeting between law and social welfare, and is a meeting between social welfare professionals and legal experts. The most original feature of this book is the 'integrated approach model of social welfare law'.
