The Constitutional Court ruled that Article 10, prohibiting night outdoor assembly, of the Law on Assembly and Demonstration was unconstitutional, on September 24th 2009. It said that the article unduly restricted the people``s basic right to freedom of expression, and so it must be revised before June 30th 2010. Article 21 of Constitution pointed Licensing or censorship of speech and the press and licensing of assembly and association shall not be recognized. However the 18th National Assembly failed revision, and the new N.A. began its term on May 30th 2012. This paper evaluated the unconstitutionality decision and suggested constitutional revision of the law.
