지방분권과 행정구역개편의 행정법적 문제

다국어 초록 (Multilingual Abstract)

The Reorganization of Administrative Zone is urgent task to be examined, which is a basic work to realize the decentralization of power. Many conditions are needed to achieve that goal but the citizen's active participation is necessary. But, relating to this point, the prescription of the Constitution and the Local Government Act is insufficient to derive the citizen's participation as a constitutional right. In addition to this, the Constitutional Court takes negative position on the citizen's participation that it takes the procedure of opinion hearing of a local assembly prescribed in the Local Government Act as a hearing procedure. Those problems mentioned above mainly come from the malfunction of the prescription of the Constitution on Local Autonomy which should function as give authority and defence power to the Local Government, but it is big problem that the Constitutional Court itself underestimate the citizen's participation. It is urgent to improve the interpretation of the Constitution and reform the Local Government Act including the improvement of the means of settling conflicts about the reorganization of administrative zone.
