중국물권법상 소유권제도의 구조적 특징에 관한 일고 = Structural Characteristic of Ownership System in China Real Right Law

다국어 초록 (Multilingual Abstract)

This article is introduced to structural characteristics and contents of ownership system in China Real Right Law. The law began to operate on 1 October 2007. During the past 10 years, ownership system is accompanied by rapid economic development and change. Basically this has been maintained three types of the State ownership system, concentration ownership system and individual ownership system.
However for the three kinds of ownership types have been established equal protection rules and with advance of capitalist system has been subdivided of various forms of concentration ownership system. Also the scope of private property has been expanded. Market economy system is prepared for more advanced legal basis through the Real Right Law.
However serious problems have accumulated the diversity and complexity of ownership, ideology of the State ownership, concentration ownership and relation of market economy etc. Particularly whether the owner of enterprise should belong to the State ownership or concentration ownership, and whether ownership of concentration property should belong to concentration organization itself or all the member.
Whether the legal relation of all the concentration organization and membership is comprehended to unify or ownership of concentration property is exercised any way. Profit structure of concentration enterprise and personal profit of members should required how such issues should be linked with through analysis and review.

국문 초록 (Abstract)

이 글은 새롭게 제정·시행되고 있는 중국 물권법상 소유권제도의 구조적 특징과 내용을 소개하는데 목적을 두고 쓴 것이다. 물권법은 2004년에 개정된 헌법에 터 잡아 보다 진전된 형태의 소유권 보호제도를 마련하였지만, 여전히 급변하는 경제상황의 변화에 부응하지 못하는 한계를 보이고 있다. 특히 물권법은 다양한 유형의 사소유권의 객체들을 예시적으로 열거함으로써 시장경제를 운영하기 위한 규범적 기반을 마련한 셈이지만, 소유권의 다양성과 복잡성, 국가소유권의 이념성, 국가 내지 집체소유권과 시장경제와의 관계 등 해결해야 할 난제들은 여전히 산적해 있다고 할 수 있다.
특히 기업의 소유 주체가 국가인제 집체인지, 집체재산의 소유권이 구체적으로 집체조직 자체에 귀속하는지 아니면 전체 구성원에게 귀속하는지, 모든 집체조직과 구성원과의 법률관계를 통일적으로 파악할 수 있는지, 집체재산의 소유권은 누구를 통해 어떠한 방식으로 행사되는지, 다양한 형태로 개혁되고 있는 집체기업의 수익구조를 구성원(내지 주주)의 사적 이익과 어떻게 연계시켜야 하는지 등의 문제는 앞으로도 면밀한 검토와 분석을 요구한다 하겠다.
