합리적 분권 : 광역 및 기초자치단체간의 기능배분 Distributing Functions between Local Governments in Korea = Rationalizing Decentralization

국문 초록 (Abstract)

이 연구는 지방자치의 정착을 국가적 과제로 두고 있는 한국의 합리적 분권화를 위해 정부간 기능배분 가운데 특히 광역자치단체인 시 · 도와 기초지방자치단체인 시 · 군 · 구간의 사무배분의 문제를 처방적 접근방법에 의해 현상을 진단하고 합리성을 제고 하기위한 개선방안을 제시함으로써 입법을 통한 지방자치제도화의 기초를 제공하고자 하는 데 목적이 있다.
한국의 기초 및 과역자치단체간의 기능배분의 문제점으로는 기초 및 광역자치단체간 사무의 중복, 사무배분기준의 모호, 공동사무의 존재, 위임사무의 법령상 근거의 부재를 지적하였으며 운영상에 있어서도 위임사무의 과다, 지방비부담의 과중, 중앙 및 광역자치단체의 기초지방자치단체에 대한 과중한 감독과 통제가 문제점으로 지적되었으며 이를 개선하기 위한 방안으로 기능배분의 재조정, 사무구분의 명확화, 지방비부담의 감경, 감독범위의 명확 및 지원의 확대, 사무처리절차 개선, 사무배분의 원칙과 우선순위확립, 사무배분조정 전담기구의 설치 방안이 제시되었다.

This study is to suggest some altematives and improvements for redistributing functions between lower and middie level local governments , which is one of the most important part in order to stabilizing the local autonomy system in Korea. Nevertheless more than 10- years' experience of local self-government, there still remain a lot of tasks for redistributing functions between lower and middie level local governments because Korea has been dominated by highly centralized national power for long period of times. Major problems and obstacles to rationalizing decentrallzation in Korea are as fonows: 1. Overlapping of tasks between lower and middie level local governmlents. 2. Ambigm· ty of criteria and legislative regulations for distributing functions. 3. Existence of tasks Which are undertaken by both local governments. 4. Too marly delegated tasks without legal authority and financial subsidies. 5. Unnecessary inspectioll and control over lower level local governments. In order to fuffil the ideofogies and enhance the rationality of decentralization, these problems and obstacles should be removed on the bases of proper legal amendrrlent. Establishing a organization win be helpful to undertake these tasks exdusively and continually.
