우리나라 지적 제도 운영의 문제점 및 개선방안 연구 = A Study on the Problem and Improvement of a Korean Cadastral System

국문 초록 (Abstract)

지적제도는 토지와 관계되는 정보활동을 담는 그릇으로서 국가의 토지행정 및 개인의 재산권보호를 위한 기초가 되고 있다.
그러나, 우리나라의 지적제도는 일제침략기에 속성으로 완성되어 지금까지 별다른 발전없이 유지되고 있기 때문에, 토지등록에 관한 실체법적 성격을 규정하는 내용이 매우빈약하며, 지적행정의 직제편성 및 인력 운용등이 불합리하게 이루어지고있고, 지적측량의 방법과 절차가 과거 열악한 환경하에서 생성된 지적정보에 크게 의존하고 있기 때문에 많은 문제점을 내포하고 있다.
이 연구는 현행 우리나라 지적제도 운영의 문제점을 해결하기 위하여, 법률적 측면에서 지적제도는 지적정보의 정확성 유지를 통해 공신력을 확보하여야 하며, 행정적 측면에서는 민주성을, 기술적 측면에서는 토지정보체계를 구축할 수 있는 기반 마련을 주요내용으로 하고 있다. 이러한 방안의 실행을 통하여 우리나라 지적제도는 동일 토지를 대상으로 하는 하나의 토지등록체계로 통합되어 보다 효율적이고 합리적인 국가행정으로서의 역할을 수행할 수 있으며, 21C 국제화·지방화·지식정보화 시대에 경쟁력을 갖추게 될 것이다.

다국어 초록 (Multilingual Abstract)

A cadastral system occupies a large part of the whole information activities relating to land. And it forms the basis of the national administration and confirmation of the property. It means that a cadastal system must be possessed of all things in order to perform its a duty.
However, a korean cadastral system was carelessly accomplished under the rule of Japanese imperialism and has been maintained until now. For that very reason, a cadastral system in Korea has many problems in the legal, administrative and technical aspect.
Consequently, a main purpose of this study is to find a solution to a problem in a korean cadastral system. In addition, this study intends to show developmental plans.
This study compares a korean cadastral system with foreign its system in order to present an objective theory. And also during the packing process, this study depends on leading theses and references to cadastral system.
This study proposes the following plan: above all, a korean cadastral system must secure public confidence legally. It must also become the democratic system administratively and it must come up to a land information system.
After going through the necessary formalities, it's being gradually integrated with a real estate registration system. That's what we expect of an authentic land registration system.
In fact, it's a portion to show a problem and a reform measure in this study. But, it's what we certainly must solve under the current cadastral system. After all, we suggest that the government have to improve the existing cadastral system in haste.
