AI 디지털교과서 법령 현황 및 법적과제 = The Status of AI Digital Textbook Laws and Legal Challenges

국문 초록 (Abstract)

윤석열 정부는 2022년 지능정보사회에 맞는 미래 인재양성과 이를 위한 정책 추진을 국정과제로 설정하였고, 교육부는 이에 따라 “디지털 인재양성 종합방안”과 “모두를 위한 맞춤 교육의 실현 디지털 기반 교육혁신 방안”을 마련한 바 있다. 이 정책들은 AI 디지털교과서의 개발 및 배포를 핵심내용으로 하고 있고, 구체적인 계획은 2023년 6월 “AI 디지털교과서 추진 방안” 수립하여 추진하고 있다.
우리나라 디지털교과서 정책은 2007년부터 시작되어 오늘에 이르고 있는데, 특히, 디지털교과서의 가장 큰 법적 문제 중 하나인 디지털교과서의 법적 지위를 부여하는 등의 내용을 담은「교과용도서에 관한 규정」개정안이 입법예고된 바 있다.
이 글은 윤석열 정부의 AI 디지털교과서 정책이 현행 우리나라 법령체계에서 가지는 한계와 문제점을 분석해 보고 앞으로 해결해야 할 법적 과제를 제언해 보고자 하였다. 단편적으로 「교과용도서에 관한 규정」을 개정함으로써 AI 디지털교과서 관련 법적 문제가 해결될 수 있다고 보이나, AI 디지털교과서가 독립된 법적 지위를 가지고 또한 안정적으로 개발 및 활용하기 위해서는 「초·중등교육법」, 「저작권법」, 「개인정보보호법」등 관련 법령들을 다각적으로 검토·분석하여 법적 과제들을 해결할 필요가 있다.

The Yoon Seok-yeol government has set the nurturing of future competency suitable for the intelligent information society and the promotion of policies for this as a national task in 2022.
The Ministry of Education has established a “comprehensive plan for nurturing digital competency” and “a digital-based education innovation plan to realize customized education for all.” ” has been prepared. These policies have the development and distribution of AI digital textbooks as their core content, and specifically, the “AI Digital Textbook Promotion Plan” is being established in June 2023 and various implementation plans are being prepared and promoted.
Korea's digital textbook policy began in 2007 and continues to this day. Among the problems with digital textbooks, the biggest legal obstacle, the "Regulations on Textbooks," was revised and new special regulations on digital textbooks were established. The legislation has already been announced.
This article analyzes the overall laws and regulations related to digital textbooks that are necessary for the development and distribution of AI digital textbooks to produce results that the public can feel, and proposes the limitations and problems of the laws and future tasks. As a result, it appears that the problem can be resolved by piecemeal revision of the “Regulations on Textbooks,” but it is only a stopgap measure. In order for digital textbooks to have the same legal status as book-type textbooks, a comprehensive review and analysis of related laws and regulations is necessary. It was suggested that revisions must be made across the board to enable stable development and use.
