Korean Civil Law does not provide provisions admitting the efficacy of public faith of the real-estate registration. However, today's economic circumstances and the parties of transactions want it. Transactions of the real-estate property become more and more frequent and the necessity of static stability cannot be neglected.
Then the person who bought other's property may be damaged. Because the real-estate registration always does not reflect the real right relation. I studied a regulating method about the conflict of both the static stability and the safety of transaction. I propose that "Public Faith Guarantee Fund" should be established. The Fund should guarantee those who wanted to be guaranteed and paid some money to Fund from loss.
