종속적 전문직화: 20세기 한국 법률전문직 장 내 법무사의 위치와 역할 = Subordinate Professionalization: The Position and Role of Judicial Scriveners within the Field of Legal Professions in Twentieth Century Korea

국문 초록 (Abstract)

이 글은 20세기 한국 법무사의 역사적 발전 과정을 사회학의 전문직화와 사회학적장의 이론적 결합을 통해 설명한다. 자유전문직에 대해 사법 관료의 우위가 관철되며 자유전문직 내에서도 변호사가 주도하는 위계적인 공간을 한국 법률전문직의 장으로, 국가, 관료제, 다른 전문직과의 관계를 통해 전문직화가 설명되어야 한다는 두이론화를 바탕으로 하여, 한국의 법무사가 제도화된 자격 체계와 종사자 단체의 설립, 업무 영역을 확보하는 과정을 역사적으로 분석한다. 법무사는 한국 법률전문직장의 관료제 의존적인 폐쇄성, 제한된 업무 범위, 국가의 단속 대상이면서도 많은국민에게 믿을만한 법률서비스를 제공해 온 독특한 전문직화의 경로를 밟아 왔다. 법무사가 대중적인 법률서비스를 제공하는 중요한 역할을 수행하면서도, 제도적으로는 사법 체계의 주변부에 머물게 된 모순적 특징을 가지게 되었다는 이 글의 분석은전문직화의 외형적 요건의 충족과 종속적인 관계가 공존하는 특유한 전문직화를 도출해 낸다. 한국 법무사가 종속적 전문직화를 거쳤다는 이 글의 결론은 전문직화를단순한 ‘성공과 번영’의 서사로만 다루어 온 기존 이론의 한계를 극복하고, 종속적관계 속에서도 전문적 지위와 사회적 역할을 유지하며 존속해 온 전문직의 새로운형상을 제시한다.

다국어 초록 (Multilingual Abstract)

This paper explains the historical development of Korean judicial scriveners in the 20th century through the theoretical integration of sociology’s professionalization and sociological field theories. Based on the theoretical framework that the field of Korean legal professions is a hierarchical topological space dominated by judicial bureaucracy over liberal professions, and within liberal professions, led by lawyers, and that professionalization must be explained through relationships with the state, bureaucracy, and professions. The research historically analyzes the process by which judicial scriveners secured an institutionalized qualification system, established a professional association, and secured their own work boundary. Judicial scriveners have followed a unique path of professionalization: despite the bureaucracy-dependent closed nature, their limited scope of practice, and being subject to state regulation, they have provided reliable legal services to clients. This analysis reveals that while judicial scriveners play a crucial role in providing popular legal services, they have institutionally remained on the periphery of the field of legal professions in Korea. This contradictory feature results in a unique form of professionalization where the fulfillment of formal professional requirements coexists with dependent relationships. This paper’s conclusion that Korean judicial scriveners underwent dependent professionalization overcomes the limitations of existing theories that have treated professionalization solely as a narrative of ‘success and prosperity’.
