국회의장의 갈등조정력 강화 방안에 관한 연구

국문 초록 (Abstract)

2012년 국회법(속칭, 국회선진화법) 개정은 우리나라 의정 역사상 한 획을 긋는 중요한 조치였다. 수십년간 지 속되어온 여야 극한 대결을 한 순간에 사라지게 했기 때문이다. 그러나 현재 나타나고 있는 부작용 또한 만만 치 않다. 여야당간 합의 부재로 미처리법안들이 쌓여만 가고 있다. 그래서 해결책으로 직권상정 부활과 신속 처리절차 도입 및 국회의장의 의사정리·진행권 강화 등이 제시되고 있다. 이 논문은 직권상정제도를 부활시키지 않으면서 입법지연을 방지하기 위한 방안으로 국회의장의 역할에 주목 하고 국회의장이 중립적인 제3자로서 여야갈등을 해결하는데 기여할 수 있는 방안을 연구했다. 그리하여 국 회의장이 중립적 제3자로서 수행할 수 있는 역할스펙트럼과 그 역할 수행의 실효성을 확보할 수 있는 제도적 장치들을 제시하였다. 즉 국회의장이 쟁점법안을 둘러싼 여야협상이 결렬되면 합의요청, 재협상지원, 양보유 도, 중재안설득 등을 순차적으로 수행하도록 법으로 의무화하고, 그의 이러한 역할수행이 실효성을 갖도록 당 적의 중립화와 임기 연장은 물론, 선출방식의 변경과 자격요건의 설정 및 자문기구의 설치 등을 제시했다.

다국어 초록 (Multilingual Abstract)

In 2012, Korean National Assembly made an amendment on The National Assembly Law, which prohibited the speaker from exerting authority to lay a bill before plenary meeting without discussion in the standing committee. This amendment paved the way for new inter-party relation because it ended the extreme confrontations and violences between the ruling and the opposition parties that had lasted for several decades. But it has caused legislative delay. Inter-party disagreement made long the list of bills unpassed. To overcome this legislative delay, a few legislators and experts claim for restoration of speaker's authority above mentioned and accelerated procedure. This paper attended to the coordinating role of speaker as a neutral third party and suggested a few options for him to contribute to inter-party conflict resolution, which can stop legislative delay as well as violences. In the stalemate of inter-party negotiation, the speaker is required to conduct agreement- request, facilitation, conciliation and mediation in a sequential way. In addition, his enlarged role should be accompanied with the neutralization of his party identification, the lengthening of his terms, the change of selection method and the establishment of high-level advisory committee in order for it to be effective.
