기독교교정상담 수립 가능성과 그 방향 = Possibility of Establishing Christian Correctional Counseling and Its Direction

국문 초록 (Abstract)

이 연구는 효과적인 기독교교정상담의 장(field)을 모색해 보고, 기독교교정상담의 수립 가능성과 그 방향성에 대해 논의하고자 하는 문헌연구이다. 우리나라에 기독교교정상담이 절실히 필요한 상황이기는 하지만 현실적으로 이를 실시하기가 여의치 않은 현실이다. 그것은 기독교교정상담이 범죄예방에 획기적인 방안이라 할지라도 정부(법무부) 및 교정기관에서는 특정종교에 편중된 교정행정이나 상담적 지원을 하기에는 상당한 부담을 갖고 있다는 점이다. 연구자는 이 문제를 다루기에 앞서 교정상담에 대한 용어와 개념 및 개괄적 이해를 다루었다. 또 연구자는 교정상담이 학제적, 통합적 개념임을 밝히면서 일반상담과 교정상담의 차이에 대하여 비교해 보았고, 범죄자에 대한 처벌 중심의 개념, 이른바 ‘응당 보상론’(just-desert theory)으로서 범죄자는 교정, 교화대상으로 보기보다는 처벌이 우선이라는 입장과 교정, 교화가 우선이라는 입장의 갈등과 논란을 다루었다. 또 연구자는 교정상담의 현장과 방법에 있어서는 교정 시설중심의 교정상담과 교정시설 밖에서 범죄자중심의 교정상담에 대하여 모색해 보았으며, 마지막으로 기독교교정상담 수립 가능성과 방향에 대해 설명했다. 결론으로, 기독교상담자가 더욱 효율적인 기독교교정상담을 하기 위해서는 교도소나 구치소 및 소년원 등 종래의 교정시설중심의 상담을 유지해나가면서 교정시설 밖의 보호관찰상담에 중점을 두어야 한다는 것을 강조했다. 교정시설 내에 있는 수형자들은 동료 수형자들로부터 부정적 영향을 많이 받는 유해환경에 노출되어 있지만, 보호관찰 대상자들은 범죄자이기는 해도 수감자는 아니므로 동료 영향이 적고, 기독교상담, 교육, 선교, 신앙 등의 전달효과가 높을 수 있다는 잇점이 있다. 또한 성인의 경우는 집행유예 또는 사회봉사 등 중범죄자가 아닌 경우가 대부분이고, 소년범도 소년교도소에 수감될 정도의 범죄가 아니어서 보호관찰처분을 받은 경우들이 대부분이다. 따라서 기독교교정상담을 통해 재범으로 이어지지 않도록 하는 차원과 기독교교정상담의 본질이 실현될 수 있는 여건과 환경은 교정시설 밖 보호관찰상담이라고 본 것이다. 기독교상담자는 보호관찰 대상자들에게 시간과 장소의 구애됨이 없이 자유롭게 접촉하여 기독교상담을 통한 성장과 변화를 지원하고 관찰하는 방식은 교정상담의 장으로서 가장 효과적인 방안임을 결론으로 제시하였다.

다국어 초록 (Multilingual Abstract)

This research is a literature review that seeks to explore the field of effective Christian correctional counseling and discuss the possibility of establishing Christian correctional counseling and its direction. Although Christian correctional counseling is urgently needed in Korea, it is not easy to implement it in reality. That is, even if Christian correctional counseling is a groundbreaking method for crime prevention, the government(Ministry of Justice) and correctional institutions have a considerable burden to provide correctional administration or counseling support that is biased toward a specific religion. Before addressing this issue, the researcher dealt with the terminology, concept, and general understanding of correctional counseling. In addition, the researcher compared the differences between general counseling and correctional counseling while clarifying that correctional counseling is an interdisciplinary and integrated concept, and dealt with the conflict and controversy between the concept of punishment-centered criminals, the so-called ‘just-desert theory,’ which prioritizes punishment over viewing criminals as subjects of correction and education, and the position that prioritizes correction and education. The researcher explored correctional facility-centered correctional counseling and person-centered correctional counseling outside correctional facilities in terms of the field and method of correctional counseling, and finally explained the possibility and direction of establishing Christian correctional counseling.
In conclusion, it was emphasized that in order for Christian counselors to provide more effective Christian correctional counseling, they should maintain counseling centered on existing correctional facilities such as prisons, detention centers, and juvenile detention centers, while focusing on probation counseling outside correctional facilities. Inmates in correctional facilities are exposed to a harmful environment where they are greatly influenced by fellow inmates, but probationers are criminals but not prisoners, so they have the advantage of less peer influence and greater transmission effects of Christian counseling, education, missionary work, and faith. In addition, most adults are not serious criminals, such as those on probation or community service, and most juvenile offenders are not criminals who deserve to be imprisoned in juvenile detention centers, so they are mostly given probation orders. Therefore, the conditions and environment in which Christian correctional counseling can prevent recidivism and realize the essence of Christian correctional counseling are considered to be probation counseling outside correctional facilities. The conclusion is that the most effective method for correctional counseling is for Christian counselors to freely contact probationers without restrictions on time and place, and to support and observe their growth and change through Christian counseling.
