가정폭력 가해자 상담프로그램의 효과: 상담조건부 기소유예 처분과 상담위탁 보호처분의 비교 = The Effects of Criminal Justice Batterer Intervention Programs on Domestic Violence Offenses: The Comparison between Pre-trial Diversion and Court-mandated Counseling

This study compared the effectiveness of pre-trial diversion and court-ordered batterer intervention programs based on 189 perpetrators who were convicted of domestic violence, and ordered to undergo such programs, either by courts or prosecutors. Likewise, this study examined the criteria used for court-ordered batterer intervention programs and pre-trial diversion by comparing the characteristics of perpetrators who received either of the two diversion options. The study revealed that pre-trial diversion was effective in reducing psychological violence, alcohol dependency, anger, and increasing social support. Court-ordered batterer intervention programs, on the other hand, were effective in bringing in positive changes to physical and psychological violence, alcohol dependency, attitude toward use of violence, acceptance of the legal punishment, and in the partner`s intention to keep the marital relationship. ANCOVA analyses on the effectiveness of pre-trial diversion and court-ordered batterer intervention programs found significant differences in physical violence between the two options; the latter was more effective than the former in reducing physical violence. The offenders attending the court-ordered programs differed significantly from those disposed to pre-trial diversion in terms of gender, educational background of the spouse, marital status, psychological violence, and being a witness to marital violence involving one`s parents. Implications were suggested and discussed to improve the effectiveness of criminal justice interventions in domestic violence cases.
