몽골의 형사소송법상 변호인 제도에 관한 이론 및 실무 연구 = A Study on Theories & Practices of Counsels’ Rights in the Mongolian Criminal Procedure Code

국문 초록 (Abstract)

형사소송절차에서 변호인 제도는 국민의 신체의 자유를 보장하기 위한 법률전문가로서 헌법이 부여하는 보호자적 기능을 갖는 변호인으로 하여금 국가권력에 의한 부당한 침해를 방지하게 하려는 취지를 가진다.
몽골 헌법 제2장 “인권 및 자유” 제14조 내지 제16조는 “몽골법률이나 국제조약에 정하고 있는 권리나 자유가 침해된 경우에는 이를 보호하기 위하여 법률구조를 받을 수 있는 권리가 있다.”라고 규정 하고 있다. 사회가 변화함에 따라 변호사 활동도 새로운 절차와 새로운 방향으로의 변화가 요구되며 형사사건의 문제점들을 확실하게 정리하여 증거를 찾아 해결하여야 하는 변호인으로서의 의무와 책임 그리고 피의자(의뢰인)의 변호인 선임권 등이 필수적으로 요구되고 있다. 소송절차를 규정한 몽골 형사소송법 제12조에는 변호사가 증거를 수집하는 활동에 참여할 권리가 규정되어 있다. 증거 수집절차는 피의자나 피고인이 유죄가 되는지 여부를 결정할 목적인 수사의 착수 단계로서 그 증거가 형사소송법에 적용되는지 여부를 밝히는 적극적인 활동이다.

다국어 초록 (Multilingual Abstract)

Through criminal procedure, Mongolian defense counsel system under the Constitution, grants the counsel as a legal expert some rights in order to guarantee people’s physical freedom and to prevent unfair abuse of national power. The Mongolian Constitution stipulates in Article 14 and Article 16 in Chapter 2 of “Human Rights and Freedoms” that “One has a right to get legal assistance in case of violation of rights or freedom which is provided in Mongolian law.” In order to match with social changes, the activities of counsels are supposed to be reformed, accordingly, toward new procedures and ways; the designation of a counsel for a suspect and the counsel’s responsibilities of organizing defense strategies for criminal cases in a secured manner and solving the cases by evidence are necessary.
Firstly, article 12 of the Mongolian Criminal Procedure Code describing litigation procedures provides that counsels have rights to participate in collecting evidence. As the first step of investigation, which is to determine if defendant or suspect is guilty, the procedure of collecting evidence takes a decisive role to say if the collected evidence is applicable to the Criminal Procedure Code. Secondly, the Mongolian Criminal Procedure Code secures attorney’s right to join custodial investigation, which protects the accused from facing unfair and illegal treatments by investigators.
