境界鑑定測量의 評價와 改善方向 硏究 = 大邱廣域市를 中心으로

국문 초록 (Abstract)

본 硏究의 目的은 境界粉爭의 해결수단인 境界鑑定測量에 관한 專門家 意識을 調査ㆍ分析하고, 이를 토대로 境界鑑定測量에 대한 문제점을 評慣하고 改善方向을 제시하는데 있다. 이상과 같은 硏究目的을 효율적으로 달성하기 위해 調査範圍를 대구광역시의 소관청지적직공무원 92명, 지적공사 직원 69명, 토지경계 감정인 11명, 법무사 300명, 공인중개사 2.589명을 대상으로 하고, 時間的으로는 2003년 9월 15일부터 10월 14일까지를 조사대상으로 하였으며, 內容的으로는 境界鑑定測量에 대한 基礎調査, 認識度, 鑑定測量을 實施하는 理由, 信賴度를 조사하였다.
조사 결과 地籍圖上 境界와 實際占有境界와의 不一致, 境界鑑定測量의 節次와 手數料의 經濟的 負擔, 境界鑑定測量에 대한 意識水準 未洽 등으로 評價되었으며. 개선방향으로는 地籍粉爭 審判所 設置. 境界鑑定測量의 節次 및 手數料 簡素化, 現實 占有境界에 대한 法定境界化 方案이 검토되어야 할 것이며, 境界紛爭에 대한 弘報가 强化되어야 할 것으로 提示되었다.

다국어 초록 (Multilingual Abstract)

The purpose of this study is to search and analyze acknowledge of specialist about Cadastral Appraisal Surveying, solution for boundary dispute, evaluate problems of Cadastral Appraisal Surveying on the basis of it and then suggest improvement direction. For effectively achieving above purpose, the researcher selected 92 public service personnels In acreage department of small government office. 69 employees in acreage department government affairs, 11 inspectors of acreage boundary, 300 judicial scriveners and 2,589 licensed real estate agents in Daegu metropolitan city as target and selected from 15, September to 14. October in 2003 as research period. As context, basic investigation of Cadastral Appraisal Surveying, the level of acknowledge, the reason for Appraisal Surveying and the level of credit are searched.
In the result, it is estimated that boundary between on the cadastral map and possession is not correct and procedures and commission of Cadastral Appraisal Surveying are burdened so improvement directions for overcoming above things are establishment of judgment office for boundary dispute, simplicity of procedures and commission for Cadastral Appraisal Surveying and examination of the legal boundary direction for real possession boundary and publicity for boundary dispute.
