사법적 관점에서 지적재조사가 부동산거래에 미치는 효과 = A Study on Effect of Cadastral Resurvey from a Private Law Perspective on Real Estate Transaction

국문 초록 (Abstract)

지적공부는 토지의 사실관계를 등록하는 국가의 공적장부이며, 부동산등기부 표제부상 토지의 표시는 지적공부를 기초하여 기재된다. 따라서 토지이동에 따른 지적공부의 변경은 토지의 사실관계를 표상하는 등기부상 소유권 등 권리에 영향을 미칠 수 있다.
1910년 ｢토지조사법｣이 제정되어 지적공부가 작성된 지 100여 년만인 2011년 ｢지적재조사에 관한 특별법｣이 제정되어 지적재조사 사업이 시행되고 있다. 지적재조사는 토지의 실제현황과 일치하지 아니하는 지적공부의 등록사항을 바로잡는 국가사업으로 사업이 완료되면 새로운 지적공부가 작성된다. 지적재조사를 통해 경계와 면적, 지목 등 지적공부상 등록사항이 실제현황과 일치됨에 따라 부동산거래에 미치는 효과를 사법적 관점에서 분석한 결과 지적재조사에 따른 효과는 거래사고의 방지와 분쟁 감소 및 사회적 비용 절감 등으로 나타났다.

다국어 초록 (Multilingual Abstract)

An Official Cadastral Records means the public register of the nation for the fact of land, and the indication of the land is recorded on title sections of the registration of real estate based on it. Thus a change in Cadastral Records may affect ownership on the registration of real estate. Since 1910 the enactment of the Land Survey Act, Special Act on Cadastre Resurvey was enacted after about a century. Cadastral Resurvey is a national project to convert that if records do not accord with the actual conditions of land by conducting investigations and surveys on descriptions registered in official cadastral records. This study analyses the effect of Real Estate Transaction from a Private Law Perspective through Cadastral Resurvey such as land boundary, area and categories. As a result, the effects of the Cadastral Resurvey are presented in preventing transaction accidents, reducing disputes and social costs.
