The 2024 partial-amendment bill to the Public Records Act, pre-announced in August, and the declaration of emergency martial law on December 3 of the same year together laid bare the structural limits of Korea’s current 「Act on the Management of Public Records」. Because the threshold for a document to constitute a record is centered on formal approval, core traces of governing acts, such as the secure-phone server logs and the notes passed at the State Council, were left outside the scope of managed records, while the disposal-freeze mechanism lost its effectiveness through delayed activation and merely formal operation. The digital transformation, the adoption of artificial intelligence, and the expansion of private record-keeping have already outgrown the boundaries of a statute designed as a procedural law for public institutions. Even so, the 2024 government bill merely renamed the statute the “National Records Act”; lacking any substantive basis for supporting private records, it in fact narrowed the scope of public records, thereby proving for itself the limits of accumulating partial amendments.
Against this backdrop, this study clarifies the legislativetheoretical significance of the “framework act” as a legislative form in the field of records management, and the direction of the legislative restructuring that the current Public Records Act system demands. Drawing first on the works of Park Young-do (2006), Park Ji-yong (2014), and Kim Won-oh (2021), it examines the concept, types, and functions of framework acts together with the principle of systemic coherence, and thereby locates the legislative-theoretical coordinates of a Framework Act on Records. It then compares the 「Framework Act on National Heritage」, the 「Framework Act on Administration」, the 「Framework Act on Data」, the 「Framework Act on Artificial Intelligence」, and the as-yet-unenacted 「Framework Act on Human Rights Policy」 against four legislative tasks: restructuring the legal system, codifying general principles, building governance for new technologies, and avoiding symbolic legislation. It further diagnoses the structural limits of the current system along four dimensions: the approval-centered threshold for constituting a record, the hollowing-out of the disposal-freeze mechanism, the limited incorporation of private records, and the absence of responses to the digital, data, and AI environment. On this basis, the study argues that what is required is neither a partial amendment nor a sprawling, catch-all full revision, but a hierarchical restructuring that places a (tentatively named) Framework Act on Records, declaring the constitutional values and basic principles of records management, at the apex and separates out a (tentatively named) Public-Institution Records Act, with the enactment of the former and the full revision of the latter pursued in parallel. The detailed drafting of the framework act’s provisions and the translation of its core agenda into statutory text, however, are left to subsequent research.
