체육철학 : 내기 스포츠에 관한 윤리적 성찰 - 억대 내기 골프 무죄판결 사례를 중심으로 - = An ethical review of gambling sports -Focusing on the acquitted golf gambling case-

다국어 초록 (Multilingual Abstract)

A judge's ruling that gambling between golfers on the outcome of their private contests is not punishable is stirring up a controversy when he found innocent four men accused of habitual gambling by betting hundreds of millions of won in their golf performance. It is important that a judge be given a right to interpret the law differently from the precedent cases. Each case can reflect the world view of the judge, and it can present a new interpretation of the common sense. However, the golf gambling case shows that a more careful consideration is needed in order to present a new interpretation of the law for people.
This paper introduces the details of the case and reviews the basis and limitations of the judgement. It then reinterprets the limitations, focusing on two aspects. First, it points out the problems with the judgment by reviewing the concept of play, game, and sports. Secondly, it shows the limitations of the judgement by emphasizing ethics that should be practiced in sports. In sum, the purpose of the paper is to illuminate the limitations of the judgement of gambling by betting hundreds of millions of won on the course and emphasize the ethical value in sports, which can contribute enhancing people's just understanding of sports.
