비행청소년 교정보호를 위한 공공-민간 협력시스템 비교 = 한국, 이태리, 벨기에 소년보호제도를 중심으로

국문 초록 (Abstract)

본 연구는 공공영역과 민간영역의 역할이 효율적으로 분담되어 비행청소년들을 선도하고 있는 유럽의 청소년보호 모델을 우리나라의 소년보호제도와 비교분석함으로써, 효과적인 민관협력 모델을 제시하는데 그 목적이 있다. 이를 위해 국내외 문헌연구와 현장조사를 실시하였다. 문헌연구를 통해 청소년 보호의 철학적?이론적 배경을 비행청소년 인권보호의 주요 원칙(보호권, 참여권, 생명권, 발달권) 중심으로 고찰하였다. 또한 현장조사를 통해 3국(한국, 이태리, 벨기에)의 소년보호제도 및 사법처리단계별 공공-민간 협력체계를 상호비교하였다. 끝으로 비행청소년의 보호 및 선도를 위한 정책이 실효를 거두기 위해서는 공공 또는 민간의 구분을 떠나 전 지역사회를 중심으로 긴밀하게 협력해야함을 결론으로 제시하면서 민간 참여를 활성화시킬 수 있는 제도적?법적 개선방안을 정책제언으로 포함하였다.

다국어 초록 (Multilingual Abstract)

The purpose of the present study is to propose a model of public-private cooperation for juvenile delinquents by analyzing and comparing the key elements of the European protection models and the Korean approach to facilitating the participation of community resources.
In terms of methodology, a literature review and a field survey were used in all three countries examined, namely Korea, Italy, and Belgium. In Italy and Belgium, fifteen public institutions and three private juvenile centers are included in the field survey data.
Through the literature review, the relevant international laws are reviewed and we found four basic principles of rights pertaining to juvenile delinquents, such as protectionism, due-process, incarceration as a last resort, and optimal intervention. Furthermore, by means of the field survey, particular institutions and policies for juveniles in difficulty are reviewed in Italy and Belgium.
By way of conclusion, it is suggested that the resources of the whole community should be mobilized to caring for juveniles in difficulty as a duty not a choice. Furthermore, proposals for new policies and institutional reform are presented.
