북한인권법 제정 및 북한인권조사위원회 보고서에 따른 형사정책적 과제 = North Korean Human Rights Act of 2016 and Its Implication on the Criminal Justice Policy of Unification

다국어 초록 (Multilingual Abstract)

In the year of 2016, South Korea’s National Assembly passed the North Korean Human Rights Bill, after 11 years of political and legal debates. The Act is intended to “protect and improve human rights of the North Korean people. (Art.1.)” The Act includes provisions to create a North Korean Human Rights Foundation to improve the human rights situation in North Korea, and to provide humanitarian aid in line with international monitoring standards. The 2016 Act also establishes a system to document and archive information on human rights violation by the North Korean government and its political leaders that could be used for future efforts to pursue accountability for crimes against humanity.
This essay analyses the main provisions of the North Korean Human Rights Act, and further the report of Commisson of Inquiry on Human Rights in the DPRK in 2014 from the perspective of South Korean unification-criminal justice policy.
Firstly, human dignity and right of pursuing happiness should be the principle of transitional justice and criminal justice policies on North Korean human rights issues. Secondly, international efforts of pursuing accountability on North Korean human rights violation should contribute to the development of North-South Korean relationship and peace in the Korean peninsula. Thirdly, criminal justice policy for the national action plan for the promotion of North Korean human rights will be collecting data on human rights violation against North Korean citizens, contributing to international efforts on criminal trials, and assisting North Korea to promote its own human rights standards. Lastly, with North-South Korean human rigths dialogue, both North and South will make efforts to implement international human rights instruments in the area of criminal justice.

국문 초록 (Abstract)

인권은 주권국가의 배타적 관할을 넘어 국제사회의 보편적 문제다. 북한의 인권증진은 남북대화의 중요한 목적이며, 우리 민족 모두가 인간답고 행복한 삶을 누리기 위한 근본이다. 따라서 북한 인권문제의 설정과 해법 모색의 절차 및 방법은 통일추진과정과 통일 이후를 대비하는 통일 형사정책의 주요 과제이다. 그 시대적 계기는 국내적으로는 2016년 북한인권법의 제정이며, 국제적으로는 2014년 유엔 북한인권조사위원회 보고서다.
본 논문은 북한인권법과 유엔 북한인권조사보고서의 형사정책적 주요 의미를 평가하고, 북한인권법 시대를 맞이하여 남북인권대화에 기여하고 통일 이후를 대비하는 형사정책적 과제를 제시하는 데 목적이 있다.
인간존엄성의 존중과 행복추구권 보장은 우리 헌법의 최고원칙이므로, 북한인권법제도 전체의 최고원칙이기도 하다. 또한 향후 북한 인권침해 불법청산의 국내적･국제적 노력은 남북관계 발전과 한반도 평화에 기여하는 방식일 때 비로소 의미가 있다. 따라서 북한정권의 인권침해 감시･억제의 측면에서는 북한인권침해기록의 수집･보존과 국제형사재판 절차가능성도 검토하면서, 북한 내 친인권적 법제도 환경 조성의 유도･조력의 측면에서는 남북한 형법의 국제인권규범 이행을 추진해야 한다.
특히 북한인권기록 관리와 남북인권대화는 통일 이후 통일 형법 제정과 통일 형사정책 수립의 바탕이 될 것이다. 통일한국의 형법 제정의 근본원칙은 북한 인권침해를 형사법적으로, 국제형법적으로 규명하고 해결해 나가는 과정에서 모색되어야 한다. 또한 북한인권법의 제정과 국제인권규범의 요청에 따라 남북한 사이에 인권을 의제로 한 대화가 진전되는 과정에서 남북한 형법의 국제인권규범 이행이 주요과제다.
