정부의 역할과 규제협상의 효과성 -기업형 슈퍼마켓을 둘러싼 갈등을 중심으로- = The Roles of Government and the Effectiveness of Regulatory Negotiation - A Case of Super Supermarkets Conflict -

The purpose of this study is to investigate the roles of the government in the process of regulatory negotiation between groups interested in regulation. This study empirically analyzed a case of conflict between small-sized stores and Super Supermarkets(SSMs) associated with whether to regulate the entry of SSMs to the market industry. The data for this study were obtained from survey administered to 300 people, consisting of 150 people representing SSMs and 150 people representing small stores in October 2010. The analysis results are as follows: First, the respondents evaluated the roles as a regulatory control agency more positively than the roles as a conflict management agency in the process of regulatory negotiation. Second, their evaluation of effectiveness of regulatory negotiation was low. Third, the effectiveness of regulatory negotiation was influenced by the roles as a conflict management agency more strongly than the roles as a regulatory control agency. This study shows that the government should improve the roles as a conflict management agency in the process of regulatory negotiation.

국문 초록 (Abstract)

본 연구는 기업형 슈퍼마켓 규제갈등사례를 대상으로 정부의 역할을 규제협상의 효과성 측면에서 실증 분석하여 정책적 시사점을 제공하고자 하였다. 규제협상에서 정부의 역할을 탐색하고, 정부의 역할과 규제협상의 효과성 간 관계를 분석하였다. 규제협상과정에서 정부가 수행해 온 ‘규제책임기관으로서의 역할’과 ‘갈등관리기관으로서의 역할’ 중 어떠한 역할이 규제협상의 효과성에 더 강한 영향을 미치는지, 또한 이러한 역할은 응답자가 어떠한 이해집단에 속하는지에 따라 달라지는지 등을 대형 유통업체와 영세 상공인 단체에 속하는 이해관계자에 대한 설문조사를 통하여 분석하였다. 분석결과, 첫째, 기업형 슈퍼마켓 관련 이해당사자들은 규제협상과정에서 정부기관이 수행해 온 ‘갈등관리기관으로서의 역할’보다 ‘규제책임기관으로서의 역할’을 더 긍정적으로 평가하였다. 둘째, 정부의 규제협상의 효과성에 대해서는 다소 부정적으로 평가하는 경향이 있었다. 셋째, 정부의 규제책임기관으로서의 역할이 갈등관리기관으로서의 역할보다 규제협상의 효과성에 더 강한 영향을 미치는 것으로 인식하였다. 넷째, 영세 상공인일수록 규제협상의 효과성을 부정적으로 평가하였으며, ‘정부의 갈등관리기관으로서의 역할과 규제협상의 효과성 간의 관계’를 대형 유통업체에 속하는 응답자들보다 약하게 인식하였다. 이러한 분석결과 도출을 통해서 첫째, 정부는 기업형 슈퍼마켓과 같은 규제갈등에서 규제책임기관으로서의 역할에 더욱 충실할 필요가 있다는 점, 둘째, 규제협상을 통해서 사회구성원들이 보다 나은 상태에 도달할 수 있도록 토대를 마련하는데 주력할 필요가 있다는 것 등의 시사점을 제시하였다.
