권리 행사는 개인의 가치를 실현할 뿐만 아니라 공동체의 규범적 질서를 구성하는 시민적 행위이다. 권리는 개인의 의사나 이익에 기반하면서도, 타자와의 관련성 속에서 성립하는 관계적 성격을 지니며, 규범 체계와도 긴밀히 연관되므로, 권리 행사는 자율성뿐만 아니라 사회적 적절성의 요구를 함께 수반한다. 그러나 현실에서는 권리를 절대화하여 자신의 이익만을 맹목적으로 주장하는 양상이 빈번하게 나타난다. 본 연구는 이러한 긴장이 가장 첨예하게 드러나는 권리 침해 상황에 주목하여, 청소년의 권리 행사가 ‘적극성’과 ‘적절성’ 차원에서 조율되는 메커니즘을 탐색하고자 하였다.
먼저 본 연구는 자율적 권리 행사의 정서적 동력으로서 ‘권리 침해에 대한 분노’에 주목하였다. 분노는 권리 침해 상황에서 개연성 높은 감정이자 부당한 침해를 인지하고 이를 바로잡고자 하는 규범적 동기를 내포한다. 이에 본 연구는 분노 자체를 부정적 감정으로 환원하여 통제하기보다, 권리 행사 의지를 불러일으키는 원동력으로서의 기능을 분석하고, 적절한 권리 행사로 이어지도록 조율하는 기제를 탐색하고자 하였다.
이어 권리 침해가 유발하는 자기 중심적 초점을 타자로 확장하여 규범적 권리 행사를 이끄는 기제로 ‘공감 확장성(empathic expansiveness)’을 설정하였다. 이는 공감이 내집단, 중립적 외집단, 경쟁적 외집단까지 편향 없이 확장되는 정도를 나타내며, 기존 공감 개념의 한계를 보완하기 위해 도입된 개념이다. 본 연구는 공감 확장성을 공감의 내용(정서적·인지적)과 확장 양상(포괄성·일관성)으로 세분화하여 분석하였다.
종속변인인 권리 행사 방식은 목적(감정 해소·문제 해결)과 수단(사적·공적)을 결합하여 ‘감정 표출형’, ‘보복 민원형’, ‘협력 해결형’, ‘공식 요청형’의 네 가지 유형으로 체계화하였다. 이중 시민교육적 관점에서 감정의 즉각적 해소보다 실질적 문제 해결을 지향하는 문제 초점 권리 행사 방식(협력 해결형, 공식 요청형)을 상대적으로 적절한 방식으로 설정하였다. 이상의 논의를 바탕으로 다음과 같은 가설을 설정하였다.
[가설 1] 권리 침해에 대한 청소년의 분노가 클수록 모든 방식의 권리 행사 의지가 높을 것이다.
[가설 2] 청소년의 공감 확장성이 높을수록 감정 초점의 권리 행사 의지는 낮아지고, 문제 초점의 권리 행사 의지는 높아질 것이다.
[하위 가설 2-1] 청소년의 공감 확장성이 높을수록 감정 표출형, 보복 민원형 권리 행사 의지가 낮아질 것이다.
[하위 가설 2-2] 청소년의 공감 확장성이 높을수록 협력 해결형, 공식 요청형 권리 행사 의지가 높아질 것이다.
[가설 3] 청소년의 공감 확장성이 높을수록 권리 침해에 대한 분노가 감정 초점의 권리 행사 의지에 미치는 영향은 약화되고, 문제 초점의 권리 행사 의지에 미치는 영향은 강화될 것이다.
[하위 가설 3-1] 청소년의 공감 확장성이 높을수록 분노가 감정 표출형, 보복 민원형 권리 행사 의지에 미치는 영향은 약화될 것이다.
[하위 가설 3-2] 청소년의 공감 확장성이 높을수록 분노가 협력 해결형, 공식 요청형 권리 행사 의지에 미치는 영향은 강화될 것이다.
가설 검증을 위해 중·고등학생 560명을 대상으로 설문조사를 실시하였으며, 기초 통계 분석 및 조절효과를 포함한 위계적 다중회귀분석을 통해 결과를 분석하였다. 분석 결과, 분노는 네 가지 방식의 권리 행사 의지 전반을 촉발하는 핵심 동력으로 확인되어 [가설 1]은 채택되었다. 다만 분노가 문제 해결 지향의 방식으로 전환되기 위해서는 이를 조율하는 기제의 개입이 필요함을 확인하였다.
공감 확장성의 주효과와 조절효과는 하위 차원에 따라 상이한 방향으로 나타나 [가설 2]와 [가설 3]은 부분적으로 지지되었다. 먼저 인지적 공감 확장성은 포괄성과 일관성 모두 적절한 권리 행사를 이끄는 데 기여했다. 인지적 공감 포괄성(확장 수준)은 분노의 수준과 관계없이 감정 초점 권리 행사 의지를 억제하였으며, 조절효과 측면에서는 분노가 감정 초점 권리 행사 의지에 미치는 영향력을 완화하고, 협력 해결형 의지를 높은 수준으로 유지했다. 인지적 공감 일관성(균형 수준)은 분노가 협력 해결형 의지에 미치는 영향력을 강화했다.
정서적 공감 확장성의 경우 포괄성이 아닌 일관성이 적절한 권리 행사를 이끌었다. 정서적 공감의 일관성은 분노의 수준과 관계없이 문제 초점 권리 행사 의지를 강화했다. 반면, 정서적 공감 포괄성은 분노와 결합할 때 감정 초점 권리 행사 의지를 오히려 증폭시키는 조절효과를 보여, 정서적 공감의 양적 확장이 적절성 측면에서 바람직하지 않은 결과로 이어질 수 있음을 시사하였다.
이상의 결과는 다음의 시사점을 제공한다. 첫째, 권리 침해에 대한 분노를 단순히 부정적 감정으로 환원하기보다 그 의미를 해석하고 적절한 권리 행사로 전환하도록 돕는 교육적 접근이 필요함을 보여준다. 둘째, 공감을 ‘더 많이’ 촉진하는 접근을 넘어, 인지적 공감의 포괄성 확대와 정서적 공감의 조정을 포함하는 구조화된 공감 교육이 요구된다. 셋째, 공감 수준의 함께 공감의 분포와 균형(일관성)을 고려하는 교육 설계가 필요하다.
본 연구는 사회과교육에서 정의적 영역의 논의를 상태적(state) 감정까지 확장하고, 공감의 총량만이 아니라 공감 대상의 범위와 균형을 포착하는 개념으로서 ‘공감 확장성’을 체계화하였다. 나아가 공감을 이해관계가 충돌하는 권리 갈등 상황에서 자신의 권리 행사 방식을 적절하게 조율하는 기제로 재해석하고, 권리 행사를 적극성만이 아니라 적절성의 차원에서 검토할 수 있는 관점을 제시하였다. 본 연구의 내용을 토대로, 인간 본연의 감정을 교육적 맥락에서 포착하고 이를 시민적으로 적절한 판단과 행위로 연결하는 사회과교육의 논의가 확장되기를 기대한다.

The exercise of rights is a civic act that not only realizes individual values but also constitutes the normative order of a community. Although rights are grounded in individual will or interests, they are relational in nature and contextualized within normative systems. Accordingly, the exercise of rights entails not only autonomy but also demands for social appropriateness. In practice, however, the absolutization of rights often leads to the blind pursuit of one’s own interests. Focusing on situations of rights infringement where such tensions are most acute, this study explores the mechanisms through which adolescents’ rights-related actions are shaped in terms of both ‘activeness’ and ‘appropriateness’.
First, this study focuses on ‘anger at rights infringement’ as an emotional driving force underlying autonomous rights-related action. Anger is a highly probable emotional response in situations of rights infringement and embodies a normative motivation to recognize and rectify unjust infringement. Accordingly, rather than reducing anger to a negative emotion to be controlled, this study examines its function as a source of motivation for rights-related action and investigates the mechanisms that coordinate anger toward appropriate rights-related actions.
Next, ‘empathic expansiveness’ is established as a mechanism to extend the self-centered focus induced by rights infringement toward others and to guide normative rights-related actions. This concept represents the degree to which empathy extends without bias to in-groups, neutral out-groups, and even competitive out-groups, and was introduced to complement the limitations of existing empathy concepts. This study subdivides empathic expansiveness into the components of empathy (affective and cognitive empathy) and its patterns of expansion (inclusiveness and consistency).
The dependent variable, modes of rights-related action, was systematized into four types by combining purpose (emotional release vs. problem solving) and means (private vs. public): ‘emotional expression type,’ ‘retaliatory complaint type,’ ‘collaborative resolution type,’ and ‘formal request type.’ From a civic education perspective, problem-focused modes of rights-related action (collaborative resolution and formal request types), which aim for substantive problem-solving rather than immediate emotional relief, were regarded as relatively appropriate modes. Based on this framework, the following hypotheses were formulated.
[Hypothesis 1] The greater adolescents’ anger at rights infringement, the higher their intentions across all modes of rights-related action.
[Hypothesis 2] Higher empathic expansiveness will decrease intentions toward emotion-focused modes of rights-related action and increase intentions toward problem-focused modes of rights-related action.
[Hypothesis 2-1] Higher empathic expansiveness will decrease intentions toward emotional expression and retaliatory complaint types.
[Hypothesis 2-2] Higher empathic expansiveness will increase intentions toward collaborative resolution and formal request types.
[Hypothesis 3] Higher empathic expansiveness will weaken the effect of anger on intentions toward emotion-focused modes of rights-related action and strengthen its effect on intentions toward problem-focused modes of rights-related action.
[Hypothesis 3-1] Higher empathic expansiveness will weaken the effect of anger on intentions toward emotional expression and retaliatory complaint types.
[Hypothesis 3-2] Higher empathic expansiveness will strengthen the effect of anger on intentions toward collaborative resolution and formal request types.
To test these hypotheses, a survey was conducted with 560 middle and high school students. The data were analyzed using descriptive statistics and hierarchical multiple regression analyses, including tests of moderating effects. The results showed that anger functions as a core driving force that activates intentions across all four modes of rights-related action, supporting [Hypothesis 1]. However, the findings also indicated that anger alone does not ensure problem-solving-oriented rights-related action and that coordinating mechanisms are necessary for anger to be transformed into such modes.
The main and moderating effects of empathic expansiveness varied across its subdimensions, providing partial support for [Hypotheses 2] and [Hypothesis 3]. Both inclusiveness and consistency of cognitive empathic expansiveness contributed to appropriate modes of rights-related action. Cognitive empathic inclusiveness (expansion level) suppressed intentions toward emotion-focused modes regardless of the level of anger and moderated the effect of anger by weakening its influence on emotion-focused modes while maintaining high levels of intentions toward collaborative resolution. Cognitive empathic consistency strengthened the effect of anger on collaborative resolution.
In contrast, for affective empathic expansiveness, only consistency—not inclusiveness—was associated with appropriate modes of rights-related action. Affective empathic consistency enhanced intentions toward problem-focused modes regardless of anger levels. Conversely, affective empathic inclusiveness amplified intentions toward emotion-focused modes when combined with anger, suggesting that the quantitative expansion of affective empathy may lead to undesirable outcomes in terms of appropriateness.
These findings offer the following implications. First, an educational approach is needed to interpret the meaning of anger at rights infringement and help convert it into appropriate action rather than merely reducing it to a negative emotion. Second, moving beyond approaches that simply promote "more" empathy in conflict situations, structured empathy education—including the expansion of cognitive empathic inclusiveness and the calibrated use of affective empathy—is required. Third, educational design should consider not only the level of empathy but also its distribution and balance (consistency) across different targets.
This study extends discussions of the affective domain in social studies education to include state emotions and systematizes empathic expansiveness as a concept that captures the scope and balance of empathic targets rather than empathy as a total quantity. Furthermore, it reinterprets empathy as a mechanism for socially regulating one’s modes of rights-related action in contexts of conflicting interests, and offers a perspective that evaluates rights-related action not solely in terms of activeness but also in terms of appropriateness. Based on these findings, it is expected that discussions in social studies education will expand to capture inherent human emotions within educational contexts and link them to civically appropriate judgments and actions.
