This study aims to compare and analyze the land registration systems of China and Mongolia, both of which have undergone a transition from socialist systems toward market-oriented economic mechanisms, in order to identify the land registration frameworks they have adopted and institutionalized during this transition and to derive policy implications and future directions for land registration systems in transition economies, developing countries, and CIS states.
The comparative analysis reveals that both China and Mongolia have adopted mixed land registration systems that are based on state ownership of land, while allowing varying degrees of private land ownership, land-use rights, possession or tenure rights, and other derivative real property interests. However, despite this common foundation, the two countries differ significantly in the specific structure of land ownership, the diversity and legal characteristics of registered rights, the degree and institutional approach to integrating registration authorities, and the level and institutional maturity of digitalization in cadastral and registration records.
These findings suggest that the experiences of China and Mongolia provide valuable reference cases for countries seeking to reform land registration systems and modernize land administration in the context of economic transition and development. Furthermore, the study indicates that when South Korea pursues overseas projects related to land registration and land administration modernization, it is necessary to develop customized strategies that combine international standards such as the Land Administration Domain Model (LADM) with Korea’s experience in digital cadastral systems, while carefully considering the institutional contexts and stages of development of partner countries.
