독일선거제도 = 작동 원리와 한국선거에의 적용 가능성

국문 초록 (Abstract)

이 논문은 2013년 선거법 개정 이전과 이후의 독일선거제도의 작동원리를 비교·분석하고 독일식 선거제도의 한국 도입이 과연 바람직한가를 논의하는 데 그 목적이 있다. 이 논문의 주요 주장은 다음과 같다:
(1) 소선거구 최다득표제에 의한 한국의 지역구선거는 지역주의 때문에 이미 상당히 높은 비례성을 보인다. 따라서 비례성을 제고하기 위하여 독일식 선거제도를 도입하자는 주장의 설득력은 그렇게 강하지 않다.
(2) 독일식 선거제도는 지역별로 확연하게 차이가 나는 의석분포와 관련된 ?지역구도?는 완화하겠지만 득표분포와 관련된 ?지역주의?도 완화할지는 의문이다.
(3) 독일식 선거제도는 초과의석 그리고 2013년 독일식 선거제도의 경우에는 이에 더해 보상의석의 존재로 인하여 총의석이 급격하게 증가할 수 있다.
(4) 따라서 독일식 선거제도를 도입하는 것보다는 기존의 병립형 선거제도를 유지하되 비례의석의 비중을 확대하는 것이 바람직하다.

다국어 초록 (Multilingual Abstract)

The paper compares the German electoral system before the 18th German federal election in 2013 and that used in the 18th election and analyses how the two systems operate. Then it discusses whether it is desirable to import German style electoral system into Korea. The main claims of this paper are as follows:
(1) Constituency election results under the single-member plurality system currently show, because of regionalism, a rather high level of proportionality, weakening the persuasiveness of the claim that German style system should be imported into Korea to produce more proportionate results.
(2) Though German style electoral system may ameliorate regionalism in seat distribution, it is very doubtful whether it can also ameliorate regionalism in vote distribution.
(3) German style electoral system, if applied to Korean National Assembly Elections, may greatly increase the number of total seats because it admits the existence of overhang seats and in addition, if it is a variant of 2013 German electoral system, compensatory seats.
(4) Consequently, it is desirable to increase the proportion of proportional seats in the current Korean parallel mixed-member electoral system before we adopt and experiment with the German style electoral system.
