특집논문 : 행정입법 통제를 위한 국회법 개정안 파동의 헌법적 함의 = Revision of Congress Act in the Perspective of Constitutional Law

국문 초록 (Abstract)

국회법 제98조의2 제3항은 행정부의 행정입법에 대한 국회의 통제장치를 규정하고 있다. 이번에 국회 본회의를 통과했으나 대통령에 의해 거부권이 행사된 국회법 개정안은 국회의 행정입법권 통제 강화를 위해 “통보”를 “수정·변경요구”로 바꾸고 “처리계획과 그 결과 보고”를 “처리하고 그 결과를 보고”하는 것으로 바꾸어 표현상 행정입법 통제를 강화하고 있다. 본 연구는 이 국회법 제98조의2 제3항 개정 법안이 행정부의 주장대로 위헌인지 여부를 검토함으로써 국회법 개정안 파동을 헌법적 측면에서 분석하는 것을 연구목적으로 삼는다. 이를 위해 우선 우리나라에서 국회의 행정입법권 통제제도의 변천과정을 살펴보고, 국회법 개정안의 헌법 위반 여부를 행정부의 행정입법 제정권을 침해해 삼권분립원칙 위반인지의 여부와 법원의 행정입법에 대한 사법심사권을 침해해 삼권분립원칙 위반인지의 여부를 중심으로 생각해 본다. 또한 영국과 미국 등 선진 외국의 행정입법 통제제도들의 비교를 통해 행정입법 통제의 바람직한 개선방안에 대해 모색해 본다.

다국어 초록 (Multilingual Abstract)

This year, Korean Congress tried to revise Article 98-2 of Congress Act and reinforce the control power of Korean Congress against the administrative regulation. The bill passed the plenary session of the Congress but the President exercised veto power against the bill alleging that the bill was against the Constitution. This paper aims at examining whether the bill is against the Constitution as the President alleged it and analyzing the case in the perspective of constitutional law. To achieve the aim, this paper will overview the history of congressional review system of administrative regulation in Korea at first, and will examine whether the bill is against the Constitution violating the separation of power principle provided in Korean Constitutional Law. It will also examine the congressional review system of administrative regulation in the United States as well as in the United Kingdom in the comparative law perspective. Finally, based on the examinations, this paper will explore the desirable reform measures in congressional review system of administrative regulation in Korea.
