공공의 이익과 기술이전 모델 = Public Interest and Technology Transfer Models

다국어 초록 (Multilingual Abstract)

The COVID-19 pandemic in the whole world creates new risks. Considering that the purpose of drug development is to cure disease and keep healthy, the ultimate goal of this study is to review the international norms on pharmaceuticals to enhance the access to patents related to COVID-19 treatments and vaccines. The protection of drug patents are on the one hand beneficial to the development of new drugs, but on the other restricts the access of low income brackets to drugs by allowing the monopolized patent owner to set high prices on drugs. There is the need to go beyond the current controversy on patent protection and innovation and find methods for the flexibility of the protection of IPRs from the perspective of human rights. For the advancement of medicine access and the reform of the compulsory license system, this study will analyze the main issues of the TRIPS Agreement and negotiations on its revision, and propose methods for the advancement of drug access and the systematic reform for strengthening competitiveness of new medicines. In this paper I intend to review the possible solutions for technology development and transfer for the improvement of access to medicines. Furthermore, I suggest that the creation of an patents pool, patent commons and Open Covid license model would help to ensure access to key technologies.

국문 초록 (Abstract)

코로나19(COVID-19)의 발생 및 세계적 유행 단계 돌입에 따라 국가와 국제기구 등에서는 전 분야에 걸쳐 감염병 위기 대응과 관련된 정책 및 입법 대응이 중요한 화두로 등장하고 있다. COVID-19에 안정성 및 효용성이 검증된 백신 및 치료제는 아직 개발되지 않은 상태이고, 금년 내에 백신 및 치료제가 개발되더라도 이에 대한 접근권을 높이고 적정하게 공급하는 방안이 모색되어야 할 것이다. 혁신적인 신약의 개발촉진 및 의약품 접근성 확보를 위한 국제적 논의 동향을 검토함으로써 정책적 함의를 도출할 필요가 있다. 의약품 개발 목적 중의 하나가 질병 치료와 건강 향상이라는 관점에서 볼 때, 특히 ‘필수의약품’의 접근권 제고는 매우 중요하다.
본 논문은 의약품 개발 목적이 질병 치료와 건강 향상이라는 관점에서 볼 때, 개발된 치료제에 대한 이용가능성을 제고할 수 있는 의약품 접근권 향상을 위한 국제 규범과 특허공유 일환으로 볼 수 있는 ‘Open Covid Licenses’를 비롯한 기술이전 모델검토를 통하여 의약품의 혁신 제고와 의약품 접급권 향상을 위한 방안을 모색하고자한다.
