역외권 여성이주민과 유럽시민권: 여성이주민들의 독일정착과정을 중심으로 = Immigrant Women from the Third Countries and European Citizenship: Naturalization of Immigrant Women in Germany

This study deals with immigrant women from the third countries in Germany, in particular their social and legal status. In half a century the European Community has gone through a fundamental change. Borders among its members have collapsed. The introduction of euro has strengthened relations of its members. Since then, the European citizen law and the status of non-EU citizens have become of common interest. The division of EU citizens and non-EU citizens has been outstanding. The status of immigrants from Northern and Southern Europe has improved due to the accession of their home countries into the EU, where the status of immigrants from its former colonies and non-EU member states had been unstable. Consequently, the concept of immigrants is related to non-Europeans. Two categories emerged: European citizens and nationals from the third countries.
At the beginning they came to Germany with their fathers who had already worked with a limited work permit in Germany. The immigration of women became a new model, whereas immigrants from the third countries took the traditional works of German women. The number of immigrant women increased rapidly since the 1970s.
This study aims to examine what the motives of immigrants to Germany were, what the dominant pictures of immigrants in the politics and society of the EU are, and what the legal status of immigrants in Germany looks like. It also analyzes whether the common citizenship can lead to a segmentation or even a split of the society and the tolerance of violent racism.

국문 초록 (Abstract)

유럽연합 회원국에는 매년 많은 수의 제3국 국적자들이 더 나은 삶을 위해서 유럽으로 이주하고 있다. 독일은 경제부흥을 위한 부족한 노동력을 충당하기 위해 외국인 노동자를 불러들려 경제발전에 투입시켰다. 이들 중 일부는 독일의 이민자 귀환촉진정책에 의해 일부는 본국으로 돌아갔으나, 많은 수가 가족과 함께 독일에 정착하고 있다.정착하고 있는 가족들의 초청에 의한 이주도 늘어났지만, 최근에는 취업, 난민, 망명 등과 같은 여러 이유로 이주자들이 늘어나고 있다. 이들 중에 여성이주자들이 증가하고 있는 것도 현대적 이주의 특징이다.여성 이주자들은 배우자나 부모를 따라 이주해서 독일에서 살고 있는 역외권 여성들, 그리고 좀더 질 좋은 삶을 위하여 스스로 기간제 노동허가를 받거나, 또는 불법으로 입국한 제3국 여성들로 분류될 수 있다. 특히 외국인 노동자였던 남편이나 아버지의 거주허가권에 의존해서 비독립적 거주권을 가지고 살아온 이주가정의 여성들은 가정 내에서는 전통적 여성의 역할을 강요당하면서, 외부세계와 가정에서의 여성의 역할이 다른데서 오는 갈등과 자신들을 가부장적 체계에 묶어두는 이주민법 사이에서 혼란을 겪고 있다. 여성 이주민들이 어떻게 독일로 유입되었는지, 이들이 독일 이주생활 동안 어떠한 사회적 역할을 담당했는지 그리고 유럽통합의 시대에 이들의 사회적, 법적 위상은 어떠한지를 조명하여 현재 정립되고 있는 유럽시민권에 관한 법이 유럽통합에 속한 국민과 이주민들 모두를 위한 법인지를 진단할 필요가 있다.법적인 문제 외에도 여성이주에서 나타나는 반작용은 보수적 국수주의와 혈통주의에서 비롯된 사회계층화이다. 새로운 사회에 이주여성으로 유입된 여성은 엄격한 국수주의적 법률 아래에 그 국가의 하층계급으로 자리잡을 가능성이 높고, 그 사회의 여성들이 하기 꺼리는 일을 맡고 있다. 즉 유럽통합이란 이윤추구로 포장된 유럽연합은 또 다른 형태의 계급사회를 형성할 가능성이 크다. 유럽연합회원국들에서 국가적 차원의 법개정과 차별철폐의 노력은 어느 정도 가능할 수 있으나 민간 차원에서의 혈통주의, 외국인 배타주의는 상당기간 지속될 것이다.
