통일 후 효율적 지적조사를 위한 법적 정비방안 = A Study on Legal Improvement Plan for Efficient Cadastral Survey after National Unification

Both Koreas have been under different political order and economic norms for a long time, there is no doubt that there will be a lot of difficulties and obstacles for them to be integrated in various sectors after unification. Legal integration and discussion on various legal issues after unification could be promoted when the unification outlook and plan are specifically set. Because they might be significantly influenced by political, economic and social factors in the process of unification, they have fundamental limitations. Right now, in addition, it is really hard to predict how South and North Koreas would be united into a single nation. Therefore, cadastral laws including North Korea’s land matters and the direction of the related cadastral survey may differ depending on the type and approach of national unification. However, the development of a legal improvement plan and related organizations and survey approaches for efficient cadastral survey in North Korea to be prepared against national unification would be the foundation for the development of a new cadastral system for a united Korea and reduction of related costs. To carry out a cadastral survey in North Korea, it is required to correct and improve different cadastral control points between the South and the North, convert and integrate cadastral coordinates and establish the ground for cadastral survey on North Korea. Of course, it is important to make use of North Korea’s cadastral control points, cadastral records and cadastral laws and seek cooperation from North Korean people. For this, cadastral survey on North Korea should be gradually prepared, and there should be a comprehensive survey on North Korea’s cadastral laws and related personnel, organization, technology and administrative districts. Based on the results, this study attempted to propose a legal improvement plan for cadastral survey on North Korea and suggest an efficient cadastral survey approach through a pilot project.

국문 초록 (Abstract)

남북한이 상이한 정치 및 경제규범 질서를 장기간 유지하고 있었기 때문에 통일 후 각 분야별로 남북한이 통합하는 데는 많은 장애사유로 작용할 뿐 아니라 그 과정에서 매우 많은 어려움이 발생할 것은 분명하다. 물론 남북한 통일 이후에 상정되는 법통합 및 여러 법률문제의 본격적인 논의는 통일의 전망과 내용이 구체화되었을 때 본격화될 수 있고, 실제 통일의 과정에서 정치·경제·사회적 요인에 의해 크게 좌우될 수 있다는 점에서 본원적인 한계를 갖는다. 더욱이 남북한이 통일된다고 하더라도 현 시점에서 어떠한 형태로 통일될 것인가는 예측하기 어렵다. 따라서 향후 통일의 방식과 유형에 따라서 북한의 토지문제를 비롯한 지적법제와 그에 따른 지적조사 역시 해결방향이 달라질 수밖에 없다. 하지만 통일에 대비한 북한지역의 효율적인 지적조사사업 시행을 위한 법적 정비방안을 구상해보고 이에 필요한 최적의 조직, 조사방법 등을 계획하는 것은 사업비용을 줄이고 통일 한반도의 지적제도 구축을 위한 초석이 되리라 본다.
북한지역의 지적조사를 구체적으로 행함에 있어서는 우선 남북한의 상이한 측량기준점을 정비·구축하고 남북한의 좌표를 변환·통합하여 북한지역의 지적조사 기반을 마련하는 것이 선행되어야 한다. 물론 사용가능한 북한의 측량기준점 및 지적공부 등을 최대한 활용하는 한편 북한 지적법령을 수용하면서 북한주민의 협력을 최대한 이끌어 내는 것도 중요하다.
이를 위하여 북한지역에 대한 지적조사사업은 단계적으로 준비하되 우선 북한지역의 지적조사 관련 법제, 조직, 인력, 장비, 기술, 행정구역 등 전반 현황을 조사하여야 한다. 이를 토대로 북한지역의 지적조사를 위한 법적 정비방안을 제안하고, 이에 따른 시범사업을 통한 효율적인 지적조사 방안을 제시하고자 하였다.
