초국적 제도의 민주적 정당성에 대한 고찰 = A Critical Review on Democratic Legitimacy of Transnational Institutions

This paper is intended as a preliminary step to explore the better way to reconceptualize democracy for transnational institutions. Unlike the cosmopolitan view which offers a justice-based account of legitimacy of global institutions, it examines the type of democratic legitimacy that might attach to such institutions. The strategy is to make a critical analysis of the two dominant views on democratization of those institutions: the unified demos-building view and the non-territorial pluralist view. Neither of these two views seems to be compelling or realistic because the first view has a serious 'democratic deficit' problem and the second the problem of absence of clear accountability mechanisms. Thus this paper puts forward counterarguments to these views. Then it suggests that there needs to be theorizing of a more realistic type of democratization to design the transnational institutions which are more democratic and accountable, compared with the demos-creating view and the non-territorial view.

국문 초록 (Abstract)

이 글은 세계화시대 초국적(transnational) 제도의 민주화를 위하여 기존의 민주주의 개념을 재구성할 수 있는 방법의 모색을 위한 예비단계로서 의도되었다. 초국적 제도의 정당성을 정의(justice)에서 구하는 세계시민주의의 입장과는 달리 이 글은 초국적 제도들이 지닐 수 있는 민주적 정당성의 유형을 글로벌 콘텍스트에서 고찰한다. 그 전략은 초국적 제도의 민주화와 관련해 대표적인 두 견해, 즉 ‘동질적인 통합 데모스 구축론’과 ‘탈중심적이고 비영토적인 다원주의론’을 비판적으로 분석하는 것이다. 전자는 ‘민주주의의 결핍’ 문제로, 후자는 ‘분명한 책무구조의 부재’라는 문제로 인해 현재의 글로벌 콘텍스트에서는 어느 견해도 특별히 설득력을 지니거나 현실적이라 할 수 없기 때문에 이 글은 이 두 견해에 대해 반론을 제기하고 있다. 결론은 데모스 구축론과 비영토적인 견해와 대비하여 보다 민주적이고 책임을 질 수 있는 초국적 제도를 디자인하기 위해 보다 현실적인 유형의 민주화에 대한 이론화가 필요하다는 것이다.
