교회법 제368조에 나타난 보편교회와 개별교회 사이에 존재하는 ‘상호 내재성(mutua interioritas)’에 대한 고찰 = Research on ‘mutua interioritas’ between universal church and particulars churches in the Can. 368

국문 초록 (Abstract)

교회법 제368조는 그 외형적 형태를 주의 깊게 관찰하면 “하나이고 유일한 가톨릭 교회는 개별교회들 안에 또 그것들에서 존립한다”라는 교회헌장 23항의 표현과 1917년 교회법전 제215조 1항의 형태를 취하고 있음을 알게 된다.
교회헌장 23항의 표현은 신학적이고 교회론적 의미를 드러내고 있는 반면에 구 교회법전 제215조 1항은 속지적 원칙에 근거한 교회 구역의 법률적 성격을 제공한다. 제368조가 지닌 법률적 성격과 신학적, 교회론적 성격을 분리된 것으로 보지 말고 하나의 가톨릭교회의 실재를 표현하는 두 가지 방식으로 이해할 필요가 있다. 하나의 가톨릭교회의 실재는 지역이라는 공간적, 문화적 차원에서 실재이기도 하지만 그것을 초월하여 전 세계, 더 나아가 천상교회와 지상교회가 일치해 있는 신비로운 실재이기도 하다. 아니, 교회는 신비인 것이다.
교회의 신비를 표현하는 두 가지 방식을 이해하고 그것을 연결하는데 도움이 되는 개념이 바로 ‘상호 내재성(mutua interiorità)’이다. 이것은 제368조에서 드러난 개별교회들, 특히 교구들 안에, 또 그것들로부터 하나이요 유일한 가톨릭교회가 존재한다는 신앙을 설명해 줄 수 있는 개념이다. ‘상호 내재성’이란 용어는 개별교회가, 그것들 안에서 그것들로부터 존립하고 있는 보편교회와 맺는 관계성의 밀접함, 그 신비로운 연관성을 표현한다. ‘상호 내재성’이란 표현을 통해 개별교회 안에 존재하는 보편교회가 개별교회들과 맺고 있는 연관성의 밀도는 더 강하게 표현된다.
‘상호 내재성’은 교회의 본질을 형성하는데 상호 구성적 요소이기도 하다. 따라서 개별교회의 주를 이루는 교구들이 속인적 원칙에 근거한 교회 구역임에는 분명하지만 교회의 본질을 형성하는 상호 구성적 요소인 ‘상호 내재성’의 개념을 바탕으로 그것들 간의 친교를 위해 개방적 자세로 가톨릭교회와의 친교를 이루어야 할 것이다.

다국어 초록 (Multilingual Abstract)

“Particular churches, in which and from which the one and only Catholic Church exists”(CIC can. 368). Taking a close examination of can. 368 in terms of its external structure, one can find similarities with the structure of can. 215 §1 in the 1917 Code of Canon Law, and the expression of Lumen Gentium n. 23: “in and from which churches comes into being the one and only Catholic Church.”
The latter reveals theological and ecclesiological meanings whereas the former offers a juridical character of ecclesial territory based on the territorial general rule. It is required to understand that the reality of the one and only Catholic Church is expressed in two ways; the juridical character of can. 368 cannot be separated from the theological and ecclesiological character. The reality of the Catholic Church refers to the reality in regional and cultural dimensions, but beyond that, also the reality in universal dimension. Furthermore, the Church is a mystical reality in which the Church on earth is in union with the Church in heaven, that is, the Church itself is a mystery. Hence, the concept of ‘mutua interiorità’ can be a help to understand and unite the said two ways. This concept can explain the faith that the one and only Catholic Church exists in particular churches, especially in and from dioceses, as can. 368 defines.
The term, ‘mutua interiorità’, expresses the intimate and mystical connection between the universal Church and particular churches in which and from which the former comes into being. The expression ‘mutua interiorità’ highlights the intense relationship between particular churches and the university Church.
The ‘mutua interiorità’ is an indispensible and definitive element to constitute the essence of the Church. It is evident that dioceses, major parts of particular churches, have limit of ecclessial territory in accordance with the territorial general rule. However, they, with open mind, should remain in communion with the Catholic Church in order to form the communion among themselves, based on the ‘mutua interiorità,’ an indispensible and definitive element to constitute the essence of the Church.
