주민자치제도정립과 활성화방안 = Establishment and Revitalization of Resident Autonomy System

국문 초록 (Abstract)

지방자치부활 35주년을 맞아, 주민자치제도를 법제화하려는 흐름이 있다. 주민자치제도 도입이후 25년이 흐르면서 다양한 제도들이 시도되었고, 제안되어 있다. 주민자치위원회제도와 주민자치회 시범실시가 그러한 흐름속에 있다. 주민자치제도는 해외사례소개와 분석을 통하여, 한국의 주민자치제도 정립에 어떤 선택을 해야 하는가에 대한 합의가 이루어져 있지 않다. 본고는 이러한 상황에서 주민자치제도의 본질을 다시 한번 되돌아보고, 시민성과 시민사회의 주민주권 회복이라는 방향성을 가진 제도선택이 이루어지길 바라는 마음으로 작성되었다. 이를 위해 주민자치회시범실시에서 시민사회 자치역량 토대를 형성하는 것이라든지, 주민자치회와 행정과의 관계에서 주민참여확대 노력을 해야 한다는 점, 그리고 제주사례를 토대로, 공동체 활성화정책으로 승화시켜 나가는 행정의 역할을 제시하였다. 결국 여기서 제안된 제도설계의 방향성은 시민사회영역은 물론이고, 행정-시민사회 공통영역, 국가-행정영역에서의 다각적인 제도정립의 노력이 병행해야 함을 제시하였다.

Marking the 35th anniversary of the revival of local autonomy, there is a trend to legislate the resident autonomy system. Various systems have been attempted and proposed over the past 25 years since the introduction of the resident autonomy system. The resident autonomy committee system and the pilot implementation of the resident autonomy committee are in such a trend. Through the introduction and analysis of overseas cases, there is no consensus on what choices to make for the establishment of the resident autonomy system in Korea. This paper was written with the hope that in this situation, we will look back on the nature of the resident autonomy system once again, and make system choices with the direction of restoring resident sovereignty in citizenship and civil society. To this end, it was suggested that the implementation of the resident autonomy system should form the foundation for civil society autonomy capabilities, the efforts to expand resident participation in the relationship between the resident autonomy society and the administration should be made, and the role of the administration to sublimate it into a community revitalization policy based on the Jeju case. In the end, it was suggested that the direction of the proposed institutional design should be carried out not only in the civil society domain, but also in the common administrative-civil society area and the state-administrative area.
