장애인의 동력수상레저기구 면허취득 자격 제한 제도 도입에 관한 연구 |RISS 상세보기

국문 초록 (Abstract)

본 연구는 국민 소득수준의 향상, 주 5일 근무제 정착과 해양레저 활동에 관한 관 심이 높아져 동력수상레저기구의 확산에 따른 해양사고 증가와 이를 예방하기 위한 연구에서 장애인의 면허취득 자격요건에 관한 연구가 없어 이에 대한 문제점을 알아 보고 개선하고자 하였다. 동력수상레저기구와 선박에 적용되는 ｢수상레저안전법｣과 ｢선원법 시행규칙｣의 면허취득 자격요건이 상이하다. ｢장애인복지법｣ 제46조 및 시 행령 제28조에 따라 국가자격 시험 실시기관은 장애인 응시자가 비장애인과 동등한 조건에서 시험을 치를 수 있도록 편의를 제공해야 하지만, 특정 신체 부위의 장애로 인해 해상에서 적용하는 선박 위주의 규정에 부합하지 못하여 발생할 수 있는 사고 의 위험성이 존재한다. 이러한 사고위험을 방지하기 위해 청각, 시각, 운동기능의 장 애요소가 선박에 적용되는 규정의 제약을 받는지 알아보며, 수상레저산업 선진국의 장애인 면허취득 제한과 관련된 규정을 우리나라 규정과 비교 분석하여 해상에서 선 박과 동력수상레저기구 사이 발생할 수 있는 위험 요소를 제거하고자 하였다. ｢수상 레저안전법｣ 제5조(조종면허의 결격사유 등)에 ｢선원법 시행규칙｣[별표5의 4]의 선 원건강진단 판정기준표를 개정하여 ｢수상레저안전법｣ 건강진단 판정 기준을 추가하 여 제안하고자 한다.

In this study, there is no study on the license acquisition qualifications in the study to prevent the increase in marine accidents due to the expansion of motorized water leisure equipment due to the improvement of the national income level, the establishment of the 5-day work week, and the growing interest in marine leisure activities. We tried to find out the problem and improve it. The license acquisition requirements of the ｢Water Leisure Safety Act｣ and the ｢Enforcement Rule of the Seafarers Act｣, which apply to motorized water leisure devices and ships, are different. In accordance with Article 46 of the ｢Welfare of Persons with Disabilities Act｣ and Article 28 of the Enforcement Decree, the national qualification examination agency should provide convenience for test takers with disabilities so that they can take the test under equal conditions with non-disabled people. There is a risk of accidents that may occur due to non-compliance with ship-oriented regulations. In order to prevent this risk of accidents, we investigate whether the hearing, vision, and motor function disability factors are restricted by regulations applied to ships, and compare and analyze regulations related to license acquisition restrictions for the disabled in advanced countries in the water leisure industry with Korean regulations. In this study, we tried to remove the risk factors that may occur between the ship and the powered water leisure equipment. Article 5 of the Water Leisure Safety Act (Reasons for Disqualification of Pilot's License, etc.) shall be revised and proposed by adding the criteria for determining the health examination of the Water Leisure Safety Act.
