중국 군사입법의 현황과 과제 = The Status and Tasks of PRC Military Legislation

국문 초록 (Abstract)

군사법률 체계가 어느 정도로 정비되어 있는가의 수준은 한 국가의 국방 현대화와 군대 정규화 수준을 가늠해볼 수 있는 중요한 지표라 할 수 있다.
중국의 군사입법은 현재 수량의 측면에서 비약적으로 발전하고 있다.
다만 군사입법 기관들의 권한 획정 문제를 비롯하여 불완전한 군사입법 체계,군사 법률법규 간의 충돌 현상, 군사조직법 및 군대소송절차법의 부재 등 그 군사법규 체계상의 질적 측면에서는 아직 충분하게 정비되지 못한 상태에 놓여 있다고 볼 수 있다. 특히 군사입법 권한 획정의 불명확성은 군사조직 체계와 그 상호관계의 규범에 혼란을 초래하여 군사 조직의 효율적인 기능 분배와 기능 수행에적지 않은 지장을 주기 때문에 향후 법률로써 그 권한이 분명하게 획정되어야만할 것이다.
따라서 향후 중국 군사입법은 군사입법 권한의 명확한 획정 및 법률법규 간 충돌극복을 비롯하여 군대인권보호, 무기감축, 지역안전 참여 등 다양한 분야에 있어서의 실질적인 진전이 요구되고 있다.

다국어 초록 (Multilingual Abstract)

The status of a nation's military law system is an important milestone that depicts that nation's modernization level of the national defense and naturalization level of the armed forces.
Currently, PRC’s military legislation is developing at a remarkable pace from the quantity aspect.
However, imperfection of military legislation system, frictions between military laws and regulations, lack of military organization act and armed forces litigation procedure show that the quality aspect of military law system needs improvement. Especially the obscurity of delimitation pertaining to military legislation authority causes confusions in military organizational system and its standard for mutual relationship, gravely affecting the efficient distribution of military organizational function. A law needs to be drafted to precisely delimit the authority for military legislation.
Thus the way ahead for PRC military legislation requires tangible progress in various areas and calls for actions such as clearly demarcating military legislation authorities, overcoming clashes between the laws and regulations, protecting the human rights of the armed forces, reducing the number of weapons, and participating in regional safety.
