미국 법집행 관할체계의 특수성 고찰 = 한국의 자치경찰제도 도입과 관련한 시사점을 중심으로

국문 초록 (Abstract)

최근 정치권을 중심으로 수사권독립과 더불어 자치경찰제 도입이 다시금 이슈화 되고 있다. 자치경찰 도입과 관련하여 다수의 연구들이 주요 선진국의 경찰제도를 분석하고 있으며, 미국 경찰제도로부터의 시사점도 제시되고 있다. 다만, 기존의 연구들은 미국 경찰 제도를 다소 정적인 측면에서 이해하여, 현 제도의 역사적인 맥락과 역동성을 충분하게 제시하지는 못했다. 따라서 이 연구는 미국 법집행 체계에 대한 역사적인 이해를 바탕으로 현재 관할 체계의 특수성을 제시하였다. 이와 더불어, 이러한 특수성이 수반하는 문제점을 고찰하여 자치경찰 시대를 앞 둔 한국 경찰에 대한 시사점을 도출하였다. 요약하자면, 국가경찰제도의 도입으로 국가 전체에 걸쳐 일원화된 경찰이 수립된 한국과는 달리, 미국의 법집행 기관들은 매우 다양한 연원을 가지고 있으며, 이는 오늘날 독립적인 법집행 기관이 연방, 주(state), 카운티, 시·군(municipality) 수준에서 설치되는 배경이 되었다. 이러한 미국 법집행 할 체계의 가장 중요한 특징은 파편성이라고 볼 수 있다. 관할의 파편성은 미국 서비스의 다양성 및 중복성이라는 특징의 근거가 된다. 이 연구는 미국 법집행 관할 체계의 특수성에 대한 고찰을 바탕으로, 자치경찰 시대를 앞두고 있는 한국 경찰에 대한 시사점을 도출하였다.

다국어 초록 (Multilingual Abstract)

Recently, politicians and public show interest in the introduction of the fragmented system of police. Including the discussion about fragmented system, the current literature has suggested various implications of the U.S. law enforcement system on South Korea police practice. Since these studies generally consider the system as fixed and static, the current literature do not provide historic contexts and the current dynamics regarding the system. To fill this gap, this study examined the historical backgrounds of the current U.S. law enforcement system and characterized the system. In addition, this study addressed several implications. To sum up, while South Korea has centralized national police system since its origin, the U.S. law enforcement agencies originated from various law enforcement forces, such as sheriff and watch. Thus, independent law enforcements are established in various administrative levels (e.g., state, county, and municipality). The most prominent characteristic of the system is fragmentation, and it results in diversity and duplication of law enforcement service. Given the review of the U.S. law enforcement system, the current study suggested practical implications on South Korea police.
