새로운 국가역할 모델로서 보장국가론의 의미와 가능성 = The Meaning and Potential of the Ensuring State Theory as a New Model of State"s Role

국문 초록 (Abstract)

본 논문은 새로운 국가역할에 대한 논의를 불러일으키는 현대적 계기를 분석하고, 독일 공법학계에서 주목을 받아온 보장국가론이 이러한 계기에 부응하는지와 관련하여 보장국가론에 대한 평가를 시도한다.
이에 먼저, 오늘날 국가의 역할에 대해 새롭게 주목하도록 만드는 계기와 그 특징을 살펴본다. 다음으로 독일에서 전개되어 온 보장국가론의 내용을 요약하고, 이와 관련한 우리 공법학계의 논의현황을 정리해본다. 그리고 보장국가론이 오늘날 국가의 역할에 대한 관심이 새롭게 부각되고 있는 배경과의 관계에서 갖는 의의와 한계를 제시한다.
오늘날 과학기술의 발달에 따른 급격한 사회변화에 대응하여 인간우호적이며 인간에 의한 통제가 가능한 과학기술질서를 정립해야 할 필요성이 증대하고, 다양한 위험요소가 확대되면서 안전의 중요성 부각되고 있으며, 지속가능성의 위기와 함께 공동체의 건강한 유지 및 존속을 위한 다양한 노력의 필요성이 증대하고 있다.
보장국가론은 공적과제를 스스로 이행하던 것에서 벗어나 이를 민간에 맡기면서도 이러한 과제의 이행을 보장하는 국가를 구상한다. 보장국가는 민관협력을 중시하는 가운데 특정한 영역에서 자율적인 규제가 이루어질 수 있도록 하면서도 보장책임을 수행하기 위하여 규제의 목표와 전제조건, 한계 등을 정하는 역할을 수행한다.
보장국가론은 오늘날 국가의 현황을 이해하는데 적합한 분석의 틀을 제시한다는 점, 규제와 자율의 조화를 강조함으로써 현대국가의 모순적 상황을 극복할 수 있는 방안을 단순하게 제시한다는 점 등 긍정적으로 평가할 수 있는 측면이 많다. 그러나 아직은 구체적인 내용이 확정적이지 않고 검증이 부족하다는 점도 무시할 수 없다. 또한 자율과 규제가 실질적으로 조화를 이루는 가운데 보장책임이 실효성을 발휘할 수 있도록 하는
방안을 찾는 것도 여전히 과제로 남아있다. 이러한 보장국가론을 수용하여 관련 법제를 정비하고자 하는 경우에는 우리 현실의 특수성을 반영하고 헌법적 가치의 후퇴를 방지하는 것이 전제되어야 한다.
보장국가론이 오늘날 국가역할 변화와 관련한 논의를 불러일으키는 새로운 계기들에 부응하는 국가상을 제시하는 것인지 여부는 위와 같은 한계를 극복하고 합리적인 수용을 도모하는 과정에서 드러나게 될 것이다.

다국어 초록 (Multilingual Abstract)

This study examines many issues that cause a dispute about new roles of state and evaluates the Ensuring State Theory receiving attention from german academia of public law.
Today the society has been suddenly changing with the development of science and technology making a change to the states’ roles. There is a growing need for the science and technology order amicable to human. As many risk factors increase, the importance of safety is being emphasized. A number of efforts are needed to keep our human society safe and health to response many crisis issues with sustainability.
The Ensuring State Theory formes an idea of the state that does not directly provide benefits for their people’s livelihood, but entrust civil organizations to play the role to deal public tasks. The Ensuring States take count of private-public partnerships to provide structural frameworks to let social autonomy work smoothly and establish appropriate legal frameworks. Recently, this ideas are actively discussed in South Korea.
This model of the roles of state has many advantages as follows. Especially, it can help us to understand the features of current national operations and status of states. it also is offering unique way to solve the modern states’ contradictional situation to seek regulation and autonomy at the same time. However, despite many advantages it can not be ignored that the idea is on a path to progress and lacks clarity and experience in specifics yet. It is also difficult to mix regulation and autonomy in an effective way. It remains to be seen whether or not the Ensuring State Theory is really appropriate to current states’ situation living up to people"s particular expectations through a process to overcome the above problems.
