산업형 제2종지구단위계획의 운용 개선방안에 관한 연구 : 화성시를 중심으로 = A Research on the Operation Improvement Solution for the Industrial Type of the Second Type District Unit Plan

The using district had been fixed by establishing ' A law on the country plan and the use' which is combined ' A management law on the country use' and ' The city plan law‘ in 2003. With this law, the second type district unit plan is systemized as a city plan method which can be developed by establishing the detail plan according to the principle of pre-plan and after development with the subject of the planned management district inside the management district and the development promotion district.
In the second type district unit plan district, it is available to establish a district, with having over the regular width of the land , build an apartment complex or a factory by relieving an act restriction of the planning management district, and execute a business by applying the building -to land ratio, the ratio of capacity easily.
In this research I suggest seven improvement solutions by introducing the problems through the examination of the second type district unit plan focused on Hwasung city, Kyung-ki which has the individual factories the most in Kyung-ki province and the analysis of the reality of the industrial type district unit plan in Hwasung city.
Here are the solutions.
First, under the presupposition of keeping some part of the district, it is necessary to apply the land of capacity extendedly and establish a plan which is appropriate for the industrial speciality , not limiting the planned management district and development promotion district but extending to the production management district and the agricultural district, reflecting the situation that the industrial types are getting various .
Second, it is necessary to integrate the similar systems because the environmental examination by ' the law on country plan and use' and the pre environmental examination by 'the environment policy basic law' are duplicated.
Third, I suggest that we need to have the flexibility of changing plan by clarifying it because the clear foundation about the validity of residents suggestion is insufficient even though it is prohibited to modify principally within 5 years after deciding the area unit plan district. But it is allowed to be modified when the residents' drafting is valid exceptionally.
Fourth, it is necessary to be given flexibility on the standard of the plan which is suitable for the district speciality within the range of not damaging the fundamental establishing opinion because the standard for the establishment of the second industrial type district unit plan is too much detailed, it became the obstructive factor in business execution.
Fifth, I think it is advisable to make ecology of nature which is classified as the restricted area extended the width of the possible development land by making some part of the second level land relieved.
Sixth, with a viewpoint that it is prepared for a small factory or the demand for the chief aim at the civil development, it is necessary to distribute the whole amount of the second industrial type district unit plan step by step.
Seventh, It is also necessary to modify the regulation of the minimum width level high, allowing for the preparing fundamental equipment in the second type district unit plan, based on the necessity of leading the scaled development.
Like the above, in this research I tried to contribute the activation of the industrial type of the second type district unit plan to be situated as the solution of planned development in the out area of the city by introducing the problems with it and suggesting the improvement solutions for it.

국문 초록 (Abstract)

2003년 ‘국토이용관리법’과 ‘도시계획법’이 통합된 ‘국토의 계획 및 이용에 관한 법률’이 제정되어 용도지역이 정비되었다. 이 법률에 의해 관리지역 내 계획관리지역과 개발진흥지구를 대상으로 선계획-후개발 원칙에 따른 상세한 계획을 수립하여 개발할 수 있는 도시계획 수법으로서 제2종지구단위계획이 제도화되었다. 제2종지구단위계획구역은 일정면적 이상의 규모를 확보하여 구역을 설정하고, 계획관리지역의 행위제한을 완화하여 아파트나 공장 건설을 허용하는 한편, 건폐율·용적률을 완화적용하게 하여 사업을 시행할 수 있다.
본 연구에서는 경기도내 개별공장이 가장 많이 입지한 경기도 화성시를 중심으로 제2종지구단위계획의 제도적 고찰과 화성시의 산업형 지구단위계획의 실태분석을 통해 문제점을 도출하여 개선방안을 제시하였다.
첫째, 입지선정에 있어서 계획관리지역과 개발진흥지구에 한정하기보다는 일부 구역 내 보전을 전제로 하여 생산관리지역과 농림지역까지 확대하여 산업의 유형이 다양화 해가고 있는 추세를 반영하여 산업의 특성에 맞는 계획을 수립할 수 있도록 용도지역을 확대 적용할 필요가 있다.
둘째, ‘국토의 계획 및 이용에 관한 법률’에 의한 환경성 검토와 ‘환경정책기본법’에 의한 사전환경성 검토가 중복되어 유사한 양제도의 통합이 필요하다.
셋째, 지구단위계획구역은 결정 후 5년 이내 원칙적으로 변경을 금지하고 있으나, 예외적으로 주민 입안이 타당한 경우 변경을 허용하고 있어 주민제안의 타당성에 대한 명확한 근거가 부족함으로 이를 구체화하여 계획변경의 탄력성을 확보할 필요가 있다.
넷째, 산업형 제2종지구단위계획 수립기준이 지나치게 상세하여 사업시행 제약요인으로 작용하게 됨으로 수립의 근본 취지를 훼손하지 않는 범위내에서 지역특성에 맞는 계획기준의 유연성 부여가 필요하다.
다섯째, 개발억제지로 분류된 생태자연도 2등급지의 일부 유연화를 통해 개발가능지의 폭을 넓히는 것이 바람직하다.
여섯째, 산업형 제2종지구단위계획은 소규모 공장이나 민간개발위주의 수요에 대비하고 있음을 볼 때 산업형 제2종지구단위계획 총량을 단계별로 적정 배분하여야 할 필요가 있다.
일곱째, 산업형 제2종지구단위계획의 기반시설확보 등을 감안하고 규모있는 개발의 유도 필요성에 입각하여 최소면적규정의 상향 조정이 필요하다.
이상과 같이 본 연구에서는 산업형 제2종지구단위계획의 문제점을 도출하고 개선방안을 제시함으로써 비도시지역의 계획적 개발 수법으로 자리매김할 수 있도록 산업형 제2종지구단위계획의 활성화에 기여하고자 하였다.
