산업진흥법의 실효성에 관한 연구 - 부품소재산업특별조치법을 중심으로

국문 초록 (Abstract)

과학기술의 발전 및 그 상용화에 있어서 관련 부품․소재 산업의 발전은 필수적이다. 이에 따라 전세계적으로 부품․소재 경쟁력이 모든 산업 경쟁력의 핵심요인으로 강조되고 있다. 그러나 우리나라 부품․소재산업은 아직 상대적으로 취약한 수준에 머무르고 있어 국내 산업구조의 고도화와 고부가가치화를 지연시키는 한편, 안정적인 무역수지 균형을 유지하는 데에 걸림돌로 작용하고 있다. 이러한 문제를 해결하고자 부품ㆍ소재 및 그 생산설비 산업의 발전기반을 조성하고 부품ㆍ소재전문기업 등의 육성을 통하여 국민경제의 균형있는 발전에 이바지함을 목적으로「부품·소재전문기업 등의 육성에 관한 특별조치법」(이하 ‘부품소재특별조치법’)이 지난 2000년에 제정되었다. 그리고 최근 개정된 「산업발전법」과 「산업기술혁신촉진법」과의 관계 속에서, 부품소재특별조치법은 부품소재 산업의 발전이라는 독자적인 기능을 수행해오고 있다. 그런데 한시법인 부품소재특별조치법의 효력 발생 기한이 2011년 12월 31일로 정해져 있어, 향후 부품소재 산업 발전을 위한 법제도적 준비를 해야 할 시점에 있다.
그러나 이에 앞서 부품소재특별조치법이 실제로 국내 부품․소재산업의 발전에 기여를 해왔는지 여부에 대해 검토를 해볼 필요가 있다. 실제로 산업 전반에 걸친 법제도적 이슈들을 다루고 있는 산업발전법과 기술혁신촉진을 위한 산업기술혁신촉진법이 이미 제정되어 있기 때문에, 부품․소재 분야에 특유한 부품소재특별조치법의 실효성을 검토해서, 향후 그 존치 여부를 결정하는 데에 고려해야 한다는 주장도 있다.
따라서 본 연구에서는 현행 부품소재특별조치법이 그동안 국내 부품․소재산업 발전에 기여해 왔는지 여부를 검토함으로써 이 법의 실효성 유무를 검토하고자 한다. 이를 위해 우선 부품․소재산업의 특성 및 부품소재특별조치법의 제정 경위와 내용들을 살펴보고, 관련 해외사례들을 검토한 다음, 부품소재특별조치법이 현실적으로 국내 부품소재산업 발전에 기여하고 있는지 여부를 파악하기 위해, 이 법의 수범자들인 부품․소재산업에서 종사하는 기업들을 표본 추출하여 설문조사한 결과를 분석함으로써 부품소재특별조치법의 필요성 여부를 고찰했다.

The components and materials industry of the world is going through a transition, which will create an environment where only a few of the best enterprises will survive due to the globalization of the world economy, global management of demand companies, expanding global sourcing, modularization of components, and the convergence of technology. The components & materials industry is closely connected with the finished products industry. Components & materials industry has played vital role in developing the national economy in Korea.
Most of korean components & materials companies, however, are small & medium-sized. They have not enough skilled-manpower, money and intellectual properties, etc. In many areas, the structure of korean components & materials industry. To solve these problems, government supports them by promotion policies of components & materials industry. To carry out strategies to develop components and materials industries the followings are necessary; policy assistance to develop superior products and technologies, assistance in turning developed technologies into businesses, the facilitation of support functions for small and medium sized component and materials enterprise innovations, strengthening support for the enhancement of marketing capacity and entry into overseas markets, and efficient support coordination between government agencies. These policies are based on the law. Because so-called Components & Materials Industry Promotion Acts expires in 2011, it is necessary to make a counterproposal. Considering the result of survey research, we have two choices; continuation of the existing law & enactment of an new law which governs only components & materials industry.
