채권자대위권에 기한 지적측량의 의뢰 = The application of cadastral survey based on the subrogation right of a creditor

다국어 초록 (Multilingual Abstract)

The Act of Survey, Channel Investigation and Cadaster regulates that creditors may make an application in substitution for the landowner. The creditor who has subrogation right is deemed to be the person interested to apply for the cadastral survey. Among requirements of the exercise of subrogation right, "the necessity of the preservation of claim" requires monetary claim for debtor's insolvency, whereas specific claim not. According to this purport, we can review various creditors' authority on the application of cadastral survey. Henceforth, the discussion and positive permission of the application of cadastral survey based on the subrogation right of a creditor is needed.

국문 초록 (Abstract)

「측량·수로조사 및 지적에 관한 법률」은 채권자가 채권자대위권에 기하여 토지소유자가 하여야 하는 신청을 대신할 수 있다고 규정하고 있다. 이러한 채권자대위권자는 지적측량을 의뢰할 수 있는 이해관계인에 해당된다. 민법상 채권자대위권 행사의 요건 중 “채권을 보전할 필요성”은 금전채권은 무자력을 요하나, 특정채권은 이를 요하지 않는다. 이러한 취지에 따라 가압류권리자, 경매신청자, 임차권자, 매수인, 시효취득자, 가처분권리자 등 각종 채권자의 지적측량 의뢰 권한의 인정 여부를 살펴볼 수 있다. 앞으로 구체적인 경우에 채권자대위권에 기한 지적측량 의뢰가 이루어질 수 있는지에 대한 논의가 활발히 이루어지고, 적극적으로 이를 인정하는 자세가 바람직하다.
