    이 논문은 법이 확정한 정의와 문학이 감지하는 정의의 차이를 탐색한다. 법은 제도적 절차와 증거의 논리를 통해 사실을 확정하지만, 문학은 그 과정에서 배제된 목소리와 감정, 입증 불가능한 진실의 잔여를 포착한다. 문학의 정의는 판결의 완결이 아니라, 유예와 응답, 감응의 형식으로 드러난다. 이를 위해 본 연구는 신동엽의 「금강」, 푸슈킨의 「청동 기마」, 이기호의 「탄원의 문장」, 김금희의 「세실리아」를 중심으로 서사적 형상화를 분석하였다. 신동엽과 푸슈킨은 각각 집단적 역사 서사와 개인적 비극 서사를 통해 법이 닫아버린 정의의 바깥을 드러내며, 이기호는 법적 언어의 실패 속에서 불가능한 정의의 언어를 탐색한다. 김금희는 말해질 수 없는 고통과 침묵의 윤리를 통해 타자와의 관계 속에서 정의의 새로운 가능성을 제시한다. 나아가 문학은 제도의 질서 바깥에서 결단과 환대의 윤리를 수행하며, 도래할 정의의 가능성을 예감하게 한다. 결국 문학은 법이 미치지 못하는 영역에서 정의의 기원을 다시 묻고, 불가능성 속에서도 정의를 새롭게 쓰는 (불)가능한 행위로 나타난다.

    This study explores the difference between the justice established by law and the justice perceived through literature. While law determines facts through institutional procedures and evidentiary logic, literature captures the excluded voices, emotions, and unverifiable residues that remain outside those procedures. Literary justice does not culminate in judgment or closure but appears through suspension, response, and affective engagement. To examine this, the paper analyzes the narrative configurations of Shin Dong-yeop’s Geumgang, Pushkin’s The Bronze Horseman, Lee Ki-ho’s A Sentence of Petition, and Kim Keum-hee’s Cecilia. Shin and Pushkin, in their respective historical and tragic narratives, reveal the exterior of justice that law has foreclosed. Lee exposes the failure of legal language and the impossibility of articulating justice within it, while Kim presents an ethics of silence that opens a relational dimension of justice grounded in empathy and response. Ultimately, literature performs an ethical act of decision and hospitality beyond institutional law, envisioning the possibility of justice-to-come. In this way, literature reopens the origin of justice in the realm where law cannot reach, functioning as a creative act that rewrites justice amid its very impossibility.
