영재 교육과정의 법적 규정에 대한 교육법학적 검토 = Legal Imperatives Related to Curriculum in Gifted Education

국문 초록 (Abstract)

본 연구는 영재 교육과정에 대한 법적 규정에 대한 문제를 살펴보고, 그 개선방안 을 탐색하는데 목적을 두고 있다. 이 목적을 위해 논의된 내용은 첫째, 영재교육의 본질과 ‘영재교육진흥법’의 특별법적 성격과 교육의 자율성에 대해 논의하였다. 교육의 본질은 인간의 성장에 대한 것이고, 이는 영재교육의 본질도 마찬가지로 적용되는 것이었다. 그리고 인간의 성장을 위해서는 이에 적절한 교육과정을 제공하는 학교의 자율성이 요청되었다. 둘째, 영재 교육과정의 법규 현황에 대해 살펴보았다. 여기서는 ‘영재교육진흥법’과 동법 시행령에 제시된 사항을 분석하고, 그 결과에 기초해 현행교육과정 법규에 대한 문제를 도출하였다. 마지막으로 영재 교육과정에 대한 교육법학적 검토를 수행하였다. 여기서는 ‘초․중등교육법’ 전체 조문과의 관계, 법과 시행령에 제시된 교육과정 관련 용어 사용의 부정확성, 교육과정 결정자로서 교장과 학교의 관계, 교육과정에 대한 전문성과 지원체제, 영재 교육과정 규정의 종합적 검토를 행하였다. 논의 결과 영재 교육과정의 규정에서 ‘영재교육진흥법시행령’에 제시된 규정은 삭제하고, ‘영재교육진흥법’에서 교육과정에 관한 사항을 영재 교육기관이 정할 수 있도록 하는 개선 방안을 제시하였다.

다국어 초록 (Multilingual Abstract)

This research attempts to explore legal issues related to curriculum in gifted education. For this end, first, nature of the education for gifted and talented and autonomy of education were discussed. The nature of the education for gifted and talented helped the grow of individuals and demanded autonomy in education place. Second, Legal status related to curriculum in gifted ducation was analysed. Legal regulation associated with curriculum in gifted ducation 'Act of the Promotion of Education for the Gifted and Talented' appeared to be superior to the 'Elementary and Secondary Education Act' in order to ensure the right of the gifted to receive proper education. In consequence, regulations related to curriculum in gifted education should require to obtain autonomy. But it was found the right to decide the curriculum, inconsistency of curriculum between 'Act of Promotion of Education for the Gifted and Talented' and 'Enforcement Decree Act of Promotion of Education for the Gifted and Talented', etc. Third, It was discussed legal examination related to curriculum in gifted education. Article 23 of 'Elementary and Secondary Education Act', the choice of words about curriculum, the right to decide curriculum, expertise of the implementation and organization for curriculum, improvement plan were examined. In conclusion, further attentions to legal imperatives in gifted education need to reconstruct regulations related to curriculum.
