중국 세관의 지식재산권보호제도에 관한 연구 = A Study on the Customs Protection of Intellectual Property Rights in China

다국어 초록 (Multilingual Abstract)

With the development of society, the economic effectiveness caused by intellectual property(IP) is more remarkable, and new IP forms are recognized. So, many states regard the IP as important rights, and protect them by law. As one of the Chinese IP protection system, customs protection of IP set up in 1995 and revised in 2004 and 2010. Although the new system is more developed than the old one, compare with developed country of IP protection, there are some issues should be improved. According to these issues, this paper suggest some solutions as follows: Firstly, it needs to expand the scope of object of customs protection of IP. Secondly, it needs to expand the scope of customs` powers. So customs could investigate the suspected goods without the requests from the holder of an IP. Thirdly, it needs to strengthen the punishment when the holder of an IP use the system with malicious intent. Especially, China is the biggest trading state of Korea, and Chinese market is very important to Korea. In trade between korea and china, high technology is Korea`s advantage. So the protection system of IP is very effective at keeping this advantage to Korean company. And consider the number of IP which registered in China, the study on the customs protection of IP in China is very pressing. The study on customs protection of IP in China can help the Korean companies which advance into China to use this system to protect their lawful rights.
