Under the current law, a housing association is understood as an unincorporated association, and the determination of members’ financial contributions, and increments thereof, are primarily left to private autonomy exercised via the association’s bylaws and resolutions. However, the doctrine of collective ownership and resolutions adopted at general meetings merely ensure the procedural legitimacy of collective decision-making, and not the substantive fairness of the amount imposed on individual members. Furthermore, there exists no standard for controlling project costs under the initiative of the outsourcee before the housing association is formally established, while ex post remedies through civil litigation are generally limited to reviewing procedural errors in general meeting resolutions. At the same time, the housing association project—a statutory form of housing supply established under the Housing Act—is subject to extensive public regulation throughout the project duration. Although the housing association, as the project entity, is also granted significant means of project implementation, including the right to demand sale of land, the process of allocation of project costs and risks to association members lacks a corresponding public verification mechanism. Therefore, in comparison to reconstruction projects and other major association-based development projects, what merits attention is not the management and disposal plan itself, but the continuous control framework underlying such projects: a benchmark for members’ financial burdens is established and updated at successive stages of the project, and material deviations are subject to enhanced scrutiny. The 2026 amendment to the Housing Act, scheduled to take effect in March 2027, partially reflects this concern. It requires recruitment advertisements to disclose the composition of and calculation rationale underlying project costs, imposes enhanced voting requirements at general meetingswhen project costs exceed the prescribed threshold, and introduces external verification of increase in construction costs. Nevertheless, the amendment does not explicitly identify the benchmark against which the rate of increase in project costs is to be measured, limits external verification to construction costs, and fails to establish a framework that incorporates cost information generated at different stages of the project into a continuous benchmark. This article proposes a continuous control framework for members’ financial contributions in housing association projects. At the member recruitment notification stage, the rationale underlying the initial contribution should be objectively documented to establish the initial benchmark. Thereafter, the benchmark should be updated at the stages of housing association establishment authorization and project plan approval, while material increases in members’ financial burdens should be stringently verified. This public-law approach does not aim to replace private autonomy; rather, it aims to establish the informational and procedural conditions necessary for the effective operation of private autonomy.
