All the while, local governments haven t have discretion for the formulation of local development plan, because central government has have comprehensive jurisdiction by means of many statutes and central plans.
But, in the case of Local Special Development Districts , local governments take the initiative and have wide discretion for their special district plan, according to the introduced bill. When local governments make district plans for local development, and apply Local Special Development Districts , Ministry of Finance and Economy examines the plans and appoints the special districts. Therefore, Local governments must research their local society and find proper ideas for the application of special districts at first.
Legal scholars study various special districts, for example, education districts, hospital districts, sightseeing districts, agriculture districts, and then, can give proper information for local governments. There are now serious conflicts about several problems, as such the appointment possibility of special districts in Seoul or kyunggi province, protecting public interest of education, and wilful land planning. Scholars can reform the introduced bill, and counsel local governments, so that the bill and special district plansof local governments may respect the constitutional value, and can diminish social conflicts by its deference.
