전자상거래에 관한 한·미 FTA의 평가와 향후 과제 = KORUS-FTA 제15장을 중심으로

다국어 초록 (Multilingual Abstract)

Regarding to the Electronic Commerce, KORUS-FTA Chap. 15 are consist of 9s regulation. In order to the title of regulations, general, electronic supply of services, digital products, electronic authentication and electronic signature, online consumer protection, principles on access to and use of the internet for electronic commerce, cross-border information flows, and finally definitions.
Where we are consider to KORUS-FTA Chap. 15, we have understood clearly for the six kinds of legal concept. Firstly, carrier medium means any physical object designed principally for use in storing a digital product by any method now known or later developed, and from which a digital product can be perceived, reproduced, or communicated, directly or indirectly, and includes, but is not limited to, an optical medium, a floppy disk, or a magnetic tape. Secondly, digital products means computer programs, text, video, images, sound recordings, and other products that are digitally encoded and produced for commercial sale or distribution, regardless of whether they are fixed on a carrier medium or transmitted electronically. Thirdly, electronic authentication meas the process or act of establishing the identity of a party to an electronic communication or transaction or ensuring the integrity of an electronic communication. Fourthly, electronic signature means data in electonic from that is in, affixed to, or logically associated with, an electronic document, and that may be used to identify the signatory in relation to the electronic document and indicate the signatorys approval of the information contained in the electronic document. Fifthly, electronic transmission or transmitted electronically means the transfer of digital products using any electromagnetic or photonic means. Finally, trade administration documents means forms a Party issues or controls that must be completed by or for an importer or exporter in connection with the import or export of goods.
