선원의 영사보호제도에 대한 한계 및 개선 방안 연구 = A Study on Limitations and Improvement measures of the Consular Protection System for Seafarers in the Republic of Korea

국문 초록 (Abstract)

비엔나영사협약은 해외에서 체포 ․ 억류된 외국인이 자국의 영사로부터 조력과 지원을 받아 공정한 법절차를 통해서 권리를 보장받고 불이익을 받지 않도록 재외국민의 영사보호제도를 규정하고 있다. 국제노동기구의 해사노동협약도 선원의 안전과 권리를 보호하기 위한 목적으로 영사보호제도를 규정하고 있다. 이 논문은 두 협약의 영사보호 규정을 검토하고 해사노동협약상 영사보호제도의 국제법적 한계를 분석하고 국내법적 개선 방안을 제시하였다.
해사노동협약의 영사보호제도는 선박의 기국관할권을 반영하여 기국의 의무를 규정하고 있다. 다국적 선원으로 구성된 선내조직을 선원의 국적국 영사보호만으로 보호하는데 한계가 있다. 따라서 기국의 관할권을 반영한 해사노동협약의 영사보호제도는 선원의 권리보장에 있어서 국제법적 의의가 크다. 그러나 해사노동협약의 Code B는 ILO의 감독제도의 직접적인 대상이 되지 않기 때문에 당사국의 자발적인 국내법적 이행에 의지해야 한다.
대한민국은 비엔나영사협약과 해사노동협약의 당사국으로서 조화로운 국내법 이행이 필요하나 현행 국내 법령에는 해사노동협약의 영사보호제도가 반영되어 있지 않다. 따라서 국내법적으로 형사수사규칙을 개정하여 해사노동협약상의 영사보호제도를 반영할 필요성이 있다. 또한 선원법에서 규정하고 있는 선원인권교육과정의 개편을 통해 선원과 선박소유자의 영사 접촉 ․ 통신에 대한 인식을 개선한다면 한층 선원의 영사보호제도가 강화될 수 있다고 판단된다.

다국어 초록 (Multilingual Abstract)

The Vienna Convention on Consular Relations provides the consular protection system for arrested or detained nationals overseas with communication and support from their consuls, have their rights guaranteed through fair legal procedures, and are not disadvantaged. The International Labour Organization's Maritime Labour Convention also stipulates a consular protection system for the purpose of protecting the safety and rights of seafarers. This paper reviews the consular protection provisions of the two conventions, analyzes the legal limitations of the consular protection system under the Maritime Labour Convention, and suggests ways to improve domestic law of the Republic of Korea.
The consular protection system of the Maritime Labour Convention reflects the flag State jurisdiction of the ship and stipulates the obligations of the flag State. There are limits to protect a shipboard organization comprised of multinational seafarers solely through the consular protection of the seafarer's nationality. Therefore, the consular protection system of the Maritime Labour Convention, which reflects the jurisdiction of the flag State, has great international legal significance in guaranteeing the rights of seafarers. However, the Code B of the Maritime Labour Convention is not directly subject to the ILO's supervisory system, so voluntary implementation efforts are required as it must rely on the domestic legal implementation of a party.
As a party to the Vienna Convention on Consular Relations and the Maritime Labour Convention, the Republic of Korea needs to implement harmonious domestic laws of the two conventions, but the consular protection system of the Maritime Labour Convention is not reflected in the current domestic laws. Therefore, there is a need to reflect the consular assistance system under the Maritime Labour Convention through criminal investigation rules in domestic law. In addition, the awareness of consular contact of both seafarer and shipowner has been improved through the revision of the Seafarers' Human Rights Education Course under the Seafarers' Act. It is considered that the consular protection system of seafarers can be effectively ensured.
