This paper examines the structural and recurring public law limitations of South Korea’s real estate auction system, with a particular focus on issues such as the abuse of lien claims (possessory liens), statutory superficies, the non-registration of land-use rights (commonly referred to as daeji rights), the omission of public regulatory information, and the misuse of partition sales in cases of co-ownership. Recognizing that auction procedures serve not only as civil mechanisms for the enforcement of creditor rights but also as instruments that must fulfill public law functions—including legal disclosure, rights protection, and procedural oversight—this study identifies and analyzes institutional deficiencies related to information asymmetry, procedural ambiguity, and gaps in the current legislative framework.
Drawing on a comparative legal analysis, the paper explores legislative models from other jurisdictions, including Germany’s authoritative land registration system, Japan’s pre-auction lien notification and substantive examination procedures, and GIS-based systems for the integrated disclosure of urban planning regulations. Based on these models, the study proposes institutional reform measures. Key recommendations include clarifying the interpretive criteria under Article 91 of the Civil Execution Act; introducing a notification and review system for unregistered rights; establishing an automated linkage system between public law information and both appraisal reports and rights summaries; and ensuring the procedural participation of substantive rights holders in partition sale proceedings.
These proposed reforms aim to enhance the predictability of auction outcomes and the protection of property rights for successful bidders, while also improving the transparency and administrative credibility of the auction system. Ultimately, this paper presents a framework for legal coherence and policy development in an auction system situated at the intersection of public and private law.
