    본 연구는 교회재산 분쟁을 둘러싼 미국과 한국의 판례법리를 비교·분석하고, 이를 토대로 한국적 상황에 적용 가능한 법신학적 규범모델을 이론적으로 정립하는 데 목적이 있다. 미국 연방대법원은 Watson v. Jones(1872)에서 사법회피 원칙을 선언한 이후, Presbyterian Church v. Hull(1969)과 Jones v. Wolf(1979)를 통하여 교리 판단을 배제하고 세속적 문서에 근거한 중립법원칙(Neutral Principles of Law)을 확립하였다. 이에 비해 한국 대법원은 ‘법인 아닌 사단의 총유’ 구조를 전제로 정관과 교단헌법을 중심으로 교회재산 귀속을 판단하여 왔다.
    이러한 판례의 전개를 비교법적으로 검토하고, 법의 절제(Temperantia Juris), 질서 속의 자유(Ordo et Libertas), 법의 은총성(Gratia per Legem)이라는 세 법신학적 평가축을 통해 그 규범적 의미를 재해석한다. 이를 통하여 교회재산을 개인이나 특정 집단의 사적 소유가 아니라 신앙공동체의 정체성과 사명 수행을 위한 ‘공공적 신탁재산’으로 재구성하고, 총유 법리를 신탁적 구조로 보완하는 한국형 법신학적 규범모델을 제시한다.
    결론적으로, 교회재산 분쟁은 단순한 소유권 다툼이 아니라 종교자유와 법적 질서, 교회자치와 공공성이 교차하는 영역으로 재정의될 필요가 있다. 이러한 관점은 신앙의 자율성과 사회적 책임이 조화를 이루는 판단 틀을 제공한다는 점에서 학문적 의의를 지닌다

    This study comparatively analyzes the judicial doctrines governing church property disputes in the United States and Korea and seeks to establish a legal-theological normative model applicable to the Korean context.
    The U.S. Supreme Court, beginning with Watson v. Jones (1872), articulated the principle of judicial abstention and subsequently, through Presbyterian Church v. Hull (1969) and Jones v. Wolf (1979), excluded doctrinal inquiry and formalized the “Neutral Principles of Law” approach based on secular legal documents.
    In contrast, the Korean Supreme Court has addressed church property disputes within the civil law framework of collective ownership (chong-yu) applicable to unincorporated associations, emphasizing church constitutions and denominational bylaws as primary legal standards.
    Through comparative examination of these judicial developments, this study reinterprets their normative significance along three evaluative axes of legal theology: Temperantia Juris (judicial restraint), Ordo et Libertas (freedom within order), and Gratia per Legem (law as a medium of grace). On this basis, church property is reconceptualized not as private ownership of individuals or factions but as “public trust property” serving the identity and mission of the faith community. The study further proposes a Korean legal-theological normative model that supplements the doctrine of collective ownership with a trust-oriented structure.
    In conclusion, church property disputes should not be understood merely as conflicts over ownership, but as a domain where religious freedom and legal order, church autonomy and public responsibility intersect. This perspective offers a coherent analytical framework that harmonizes the autonomy of faith with social accountability.
