정신보건 영역에서의 고지된 동의(informed consent) 과정에 관한 연구 = A Study On Informed Consent Process in Mental Health

국문 초록 (Abstract)

정신장애인들은 질병의 특성 상 치료를 결정할 능력이 없을 거라는 일만적인 편견 때문에 강제로 장기 수용되어 치료받는 경향이 많다. 따라서 본 연구의 목적은 정신 장애인의 자기 결정권과 전문직의 도덕적 의무를 보장하기 위한 고지된 동의과정 모형을 제시하고자 하는 것이다. 이 목적을 위해 윤리적 결정에 관한 철학적 이론과 고지된 동의 과정에 관한 선행연구들을 고찰하여 정신보건 영역에 맞는 고지된 동의모형을 제시하여 그 과정을 설명하였다. 이 모형은 우선 정신장애인의 동의능력 평가에서 시작된다. 평가 결과 동의능력이 있을 경우 직접동의를 얻게 되는데 이때 전문가는 정신장애인에게 적절한 정보를 제공하고 동의를 받으면 된다. 그러나 동의능력이 없다고 평가될 경우 불가피하게 대리 동의를 하게 된다. 이때는 유용성을 평가하고 그 대안이 사회적 규범과 전문직 윤리관에 의해 정당화될 수 있는지 검토하여 결정한다. 이 과정에서 중요한 것은 인간의 동의능력은 항상 변하므로 동의능력은 과정이 진행되는 동안 반복적으로 재평가되어야 한단는 것이다.

다국어 초록 (Multilingual Abstract)

People tend to perceive psychiatric patients as incompetent to determine their treatment. This bias approves the long forced admission to the inhumane mental hospital. The purpose of this study is to present the model of informed consent process, which ensure the self-determination of psychiatric patients and the responsibility of professions. For the purpose of this study, the literature review discusses the theory of philosophy-consequence based theory and obligation based theory-and the informed consent elements.
Informed consent process presented is first to evaluate the competency to give consent of psychiatric patients. If they are competent, profession provide the appropriate information and then is gave consent. However if they are incompetent, the surrogate decision making is needed. The surrogate decision making is divided into two sections : 1. To evaluate "utility" of the alternatives and 2. To justify decision by the social norms and professional ethics. Of all process, it is the most important to re-evaluate of competency to give consent continually in accordance with the change of mental status of psychiatric patients.
