16세기 제네바의 결혼, 이혼, 재혼에 관한 교회법령 연구: 가족 위기 극복을 위한 일 고찰

국문 초록 (Abstract)

본 연구는 오늘날 한국사회의 가족 문제에 대한 관심에서 출발하였다. 일반적으로 종교가 건강한 가정을 유지시킴으로써 사회통합에 기여한다고 알려져 있지만, 과연 그런지를 역사적 사례를 통해 점검해 볼 필요가 있다. 본 연구는 종교, 특별히 개신교가 주도적 역할을 했던 16세기 제네바에서 결혼, 이혼, 재혼이 어떻게 이루어졌는지를 살펴봄으로써 종교와 가족의 구성, 해체, 재구성의 관련성을 밝히려는 시도이다. 다분히 정교일치의 성격을 지니고 있던 16세기와 포스터모던 시대인 21세기를 단순 비교하는 것은 불가능하지만, 그럼에도 불구하고 본 연구를 통해 가족 위기를 극복하는 데 있어서 오늘날에도 여전히 유익한 몇 가지 통찰력을 발견할 수 있을 것이다.
본 연구는 다음과 같은 내용을 담고 있다. (1) 먼저 16세기 제네바의 법령이 결혼을 어떻게 규정하고 있는지를 살펴보았다. 16세기 개신교 도시 제네바에서 결혼을 언약(covenant)으로 이해한 것은, 결혼을 성례(sacrament)로 간주하는 중세 로마가톨릭과 사람 사이의 계약(contract)으로 보는 현대적 관점과 구별된다. (2) 이를 위해서 1546년의 결혼법령과 1561년의 교회법령을 비교 분석하였다. (3) 또한 그 당시 실제로 일어났던 사례들을 살펴보기 위해 결혼, 이혼, 재혼의 문제를 다루었던 위원회(Consistory)의 문서, 16세기 제네바의 종교지도자였던 칼뱅의 설교와 주석 등 1차 사료들과 이 주제와 관련된 2차 자료들을 고찰하였다.
이를 달성하기 위해 최근 종교개혁 연구에서 사용되고 있는 사회사적 접근방식을 택하였다. 일상사 혹은 사회사적 접근은 종교개혁 역사를 보다 다양한 관점에서 바라볼 수 있도록 해 줄 것이다.

다국어 초록 (Multilingual Abstract)

This study starts from the concern on the family problem of Korean society. While it is generally said that religion contributes to the social integration by preserving healthy family, it is necessary to examine whether it is true or not through the analysis of historical cases. This study is an attempt to disclose the relationship between religion, and formation and dissolution of marriage in the 16th century Protestant city. For this purpose I will examine how engagement and marriage, divorce and remarriage were actually arranged in 16th century Geneva.
This study includes the following contents. First, this study examines what the Genevan Ordinances say about engagement, marriage, and divorce. Genevan Ordinances regard marriage as a covenant. It is distinguished from both views of Roman Catholic Church in middle ages regarding as a sacrament and modern scholars as a contract. Secondly, this study analyzes in detail 1546 Marriage Ordinances and 1561 Ecclesiastical Ordinances. Thirdly, this study looks into how Consistory and Small Council dealt with the cases related to sex, marriage, and family issues.
